Abstract(s)
A dissertação que agora se publica subordina-se ao tema: Da simplificação administrativa no controlo das operações urbanísticas: – Em especial do deferimento tácito. Pretende-se com esta tese, em primeira linha, indagar se a ficção de atos positivos resultantes das previsões legais de deferimento tácito das operações urbanísticas é instrumento idóneo à realização dos desideratos dos princípios da simplificação administrativa e da boa administração, ambos com dignidade constitucional e essenciais para a materialização de um Estado de Direito verdadeiramente democrático.
Por outro lado, com esta investigação, aferiremos da bondade de uma política legislativa e administrativa urbanística que confira à omissão ilegal do dever de decisão administrativo o valor de presunção de favorabilidade de pronúncia das entidades externas no contexto dos procedimentos de controlo prévio, em especial no que toca à temática dos pareceres emitidos pelas entidades externas aos municípios.
Posteriormente, e neste seguimento, avaliaremos se as opções legislativas tomadas com o Decreto-Lei n.º 10/2024 de 8 de janeiro, se afiguram conformes aos valores do Direito do Urbanismo, nomeadamente os da defesa da segurança, salubridade e estética das edificações, razões de ser desta área do Direito. Avançamos que se trata de um equilíbrio complexo, uma vez que os princípios constitucionais e os valores urbanísticos supramencionados surgem, frequentemente, nos antípodas correspetivos.
Em suma, pretendemos responder fundamentadamente à questão que impreterivelmente estará no centro da presente dissertação, que é a de saber se a valoração positiva do silêncio das diversas entidades públicas participantes nos procedimentos urbanísticos será um modo de agir administrativo tolerável em face do nosso ordenamento jurídico tendo em conta os diversos interesses públicos nacionais, locais e setoriais que se colocam neste ramo do Direito.
The thesis that is now being published is written under the title: The positive silence of the Administration in the prior control of urban planning operations – Tacit approvals. The main goal of this paper is to investigate whether the fiction of positive acts resulting from the legal provisions for tacit approval of urban planning operations is a suitable instrument for achieving the aims of the principles of administrative simplification and good administration, both of which have constitutional dignity and are essential for the materialisation of a truly democratic rule of law State. On the other hand, with this research, we will assess if it is appropriate that an urban planning legislative and administrative policy gives the unlawful omission of the administrative decision-making duty the value of a presumption of favourability of the pronouncement of external entities in the context of prior control procedures, especially with regard to the issuance of opinions by entities external to municipalities. Subsequently, we will assess whether the legislative options taken with Decree-Law no. 10/2024 of 8 January are in line with the values of Urban Planning Law, namely those of defending the safety, health and aesthetics of buildings, which are the raison d'être of this area of law. We believe that this is a complex balance, since the constitutional principles and urban planning values mentioned above often appear at opposite ends of the spectrum. In short, we intend to provide a well-founded answer to the question that will inevitably be at the centre of this dissertation, which is whether the positive evaluation of the silence of the various public bodies involved in urban planning procedures is a tolerable administrative course of action under our legal system, taking into account the various national, local and sectoral public interests that arise in this branch of the law.
