Abstract(s)
A presente dissertação de mestrado versa sobre a mediação penal para as infrações penais praticadas no âmbito de relação conjugal. A violência que se manifesta nesse contexto é, no geral, uma violência de gênero - a vítima a sofre em virtude do gênero a que pertence e, em termos fenomênicos, há mais vítimas mulheres, e esta violência produz inúmeros efeitos, dentre os quais destacamos a possível assimetria de poder no interior da relação conjugal. Por outro lado, a mediação enquanto mecanismo de resolução de conflitos tem por pressuposto de eficácia uma certa igualdade entre as pessoas que a ela se lançam, e nisso se situa o desafio
teórico e pragmático em com ela compatibilizar a violência conjugal. Uma perspectiva válida para o tema é a análise da aptidão do procedimento da mediação penal em resguardar os direitos fundamentais das vítimas desta violência, servindo de base, nesse propósito, os princípios constitucionais da igualdade, da tutela judicial efetiva e da proporcionalidade, por ofertarem os recursos necessários para concluir pela compatibilidade, ou não, entre mediação penal e violência conjugal.
This master's thesis deals with criminal mediation for criminal offenses committed in the context of marital relationship against women. The violence that manifests itself in this context is, in general, gender-based violence - the victim suffers it due to the gender to which it belongs and, in phenomenal terms, there are more female victims and this violence produces numerous effects, among which we highlight the possible asymmetry of power within the marital relationship. On the other hand, mediation as a conflict resolution mechanism has as its presupposition of effectiveness a certain equality between the people who launch it, and this is the theoretical and pragmatic challenge in making it compatible with conjugal violence. The valid perspective for the theme is the analysis of the aptitude of the criminal mediation procedure to safeguard the fundamental rights of the victims of this violence, serving as a basis in this purpose, the constitutional principles of equality, effective judicial protection and proportionality, for offering the necessary resources to conclude the compatibility, or not, between criminal mediation and conjugal violence.
