Não obstante a sua importância económica e social, juridicamente a categoria dos contratos de crédito e o negócio de crédito em geral é difícil de precisar. A concessão de crédito pode assumir diversas formas, técnicas e funcionamento consoante o tipo de contrato em que se materialize. Inexistindo quaisquer normas que se assemelhem a um regime geral do crédito, é usual o recurso ao mútuo civil oneroso como “tronco” dos contratos de crédito. Na presente dissertação, iremos proceder à análise de alguns dos mais comuns tipos contratuais de crédito, procurando descortinar o seu funcionamento e natureza jurídica, buscando semelhanças ou aproximações do mútuo civil que evidenciem essa função central deste contrato. Posteriormente, com base nesses pontos comuns, iremos determinar quais as normas do mútuo civil oneroso que podem ter aplicação relevante às relações de crédito. Por fim, iremos observar as teorias que foram avançadas sobre a teoria geral do ato de crédito, buscando os elementos essenciais das relações que possam ser subsumidas a esta classificação.
Despite its’ economic and social importance, juridically the category of credit contracts and the credit relation in general is difficult to define. Credit concession can take on many diverse forms, techniques and inner workings depending on the contractual type upon which the credit relation takes form. In the absence of a general set of norms on credit agreements, the simple civil loan is often regarded as the “core” of credit agreements. In this dissertation, we will analyse some of the most common types of credit contracts, seeking to understand its workings and juridic nature, and find common ground between them and the simple civil loan agreement that makes evident said “core” function of this contract. Then, based on those common grounds, we will determine which of the civil norms that regulate the loan contract may have relevant application beyond it, in other different credit contracts. Lastly, we will shift our attention to the theories that have been proposed regarding the credit relation in general, to try and determine the essential elements of this category of acts.
