| dc.description.abstract | O estudo traz uma abordagem histórica e jurídica da subordinação jurídica nas relações de trabalho e investiga a presença dessa nas novas formas de atividades prestadas por meio de plataformas digitais on demand. Parte-se de uma breve noção histórica da regulação do trabalho humano e aprofunda-se no surgimento e evolução do instituto da subordinação jurídica, avaliando-se sua relativização com a globalização e fragmentação da produção ocasionadas pela terceira revolução industrial, chegando-se ao fenômeno da revolução 4.0 e suas características disruptivas, para avaliar se o instituto da subordinação jurídica pode continuar a ser visualizado nessas novas formas de prestação de trabalho humano. Ao final são trazidos os mais relevantes leading cases dos países de economia central e destacadas as situações atuais de Portugal e Brasil, alinhando-se conclusões dos últimos relatórios dos organismos internacionais do trabalho acerca do tema e apontando um caminho que parece ser o mais viável para o futuro da regulação dessas relações plataformizadas. | pt_PT |
| dc.description.abstract | The study brings a historical and legal approach to legal subordination in labor relations and investigates its presence in new forms of activities provided through digital platforms on demand. It starts with a brief historical notion of the regulation of human labor and delves into the emergence and evolution of the institute of legal subordination, evaluating its relativization with the globalization and fragmentation of production caused by the third industrial revolution, arriving at the phenomenon of revolution 4.0 and its disruptive characteristics, to assess whether the institute of legal subordination can continue to be seen in these new forms of human labor. At the end, the most relevant leading cases from the central economy countries are brought up and the current situations of Portugal and Brazil are highlighted, aligning conclusions of the latest reports of international labor organizations on the subject and pointing out a path that seems to be the most viable for the future of regulation of these platform relationships | pt_PT |
