O programa do Governo constitui um instituto fundamental no âmbito do sistema político gizado pela Constituição da República Portuguesa de 1976. Com efeito, além de prever expressamente esta figura e regular o seu conteúdo, a nossa Constituição impõe a sua apresentação obrigatória ao Parlamento, enfraquece a capacidade de actuação do Governo enquanto o programa não é apreciado e prevê que os membros do Governo estão vinculados ao programa, podendo o Parlamento censurar o Governo em caso de incumprimento do mesmo.
A presente dissertação procura assim captar e compreender os traços do regime constitucional desta figura singular.
The Government’s programme is a fundamental institute within the context of the political system set forth by the Portuguese Constitution of 1976. In fact, this Fundamental Law not only expressly foresees the programme but also imposes that it is mandatorily subject to the Parliament, being the Government, in the meantime, subject to a capitis deminutio. Furthermore, the Constitution provides that the governmental team is bound to the programme and that the Parliament may hold the Government accountable in case the programme is not fulfilled. This study aims therefore to understand the constitutional framework of such an important institute.
