Abstract(s)
Por meio da anĂĄlise da legislação e da jurisprudĂȘncia, buscou-se nesta dissertação o estudo do agravamento do risco no contrato de seguro sob perspectiva de direito comparado luso-brasileiro. As caracterĂsticas e as consequĂȘncias desta alteração do risco inicialmente subscrito pelo segurador foram analisadas especialmente em relação aos sistemas portuguĂȘs e brasileiro, sob a perspectiva comparada, com mençÔes pontuais a outros ordenamentos. Antes da anĂĄlise do objeto de estudo propriamente dito, alguns temas preparatĂłrios foram abordados, tais como a trajetĂłria regulatĂłria dos seguros, o conceito de risco no contrato de seguro, os deveres iniciais de informação no contrato de seguro, os dispositivos legais portugueses e brasileiros relacionados Ă fase prĂ©-contratual e a culpa in contrahendo. Nesta senda, a relação entre os deveres iniciais de informação e o agravamento do risco passa a ser explorada e, em seguida, tem lugar a conceituação sobre o que pode-se entender por agravamento material do risco. Ainda que alguns elementos do instituto do agravamento do risco sejam universais, cada uma das legislaçÔes examinadas dispĂ”e de definiçÔes e soluçÔes prĂłprias. Cada jurisdição tem dispositivos prĂłprios para regular o agravamento do risco no contrato de seguro, sendo estes analisados e comparados principalmente Ă luz da doutrina e jurisprudĂȘncia do Brasil e de Portugal. A anĂĄlise da jurisprudĂȘncia relacionada ao agravamento do risco Ă© feita ao longo da dissertação de forma a trazer ao leitor os posicionamentos mais importantes das cortes brasileiras e portuguesas ligados ao agravamento do risco. Tendo-se em conta o trĂąmite perante o Senado Federal brasileiro do Projeto de Lei da CĂąmara n.Âș 29/2017, foram examinados os seus artigos relacionados ao agravamento do risco e aos deveres iniciais de informação.
Through the analysis of legislation and jurisprudence, this dissertation sought to study the aggravation of risk in the insurance contract from the perspective of Portuguese-Brazilian comparative law. The characteristics and consequences of this change in the risk initially underwritten by the insurer were analyzed especially in relation to the Portuguese and Brazilian systems, from a comparative perspective, with specific mentions of other systems. Before analyzing the object of study itself, some preparatory topics were addressed, such as the regulatory trajectory of insurance, the concept of risk in the insurance contract, the initial information duties in the insurance contract, the Portuguese and Brazilian legal provisions related to the pre-contractual stage and culpa in contrahendo. In this way, the relationship between the initial information duties and the aggravation of risk starts to be explored and then the conceptualization of what can be understood by material aggravation of risk takes place. Although some elements of the risk aggravation institute are universal, each of the legislations examined has its own definitions and solutions. Each jurisdiction has its own provisions to regulate the aggravation of risk in the insurance contract, which are analyzed and compared mainly in the light of the doctrine and jurisprudence of Brazil and Portugal. The analysis of jurisprudence related to risk aggravation is carried out throughout the dissertation in order to bring to the reader the most important positions of the Brazilian and Portuguese courts related to risk aggravation. Considering the proceedings before the Brazilian Federal Senate of the House Bill No. 29/2017, its articles related to the aggravation of the risk and the initial information duties were examined.
