| dc.description.abstract | É notório que consoante a evolução das sociedades, a cada dia, novos direitos humanos vêm sendo reconhecidos e passam a estar sob a égide de Sistemas de Proteção. Contudo, é imperioso atentar à efetiva proteção e disponibilização dos direitos reconhecidos, em especial a educação e o acesso à justiça, direitos sobre os quais o presente estudo irá se desenvolver. A educação, e mais especificamente uma educação em direitos humanos, é também meio de acesso à justiça, haja vista que para que tal acesso se dê de forma eficaz, imperiosa uma educação jurídica dos cidadãos e não apenas de classes profissionais. Por outro lado, por vezes, somente através do direito de acesso à justiça consegue-se alcançar o direito à educação. Com isso, o presente estudo transitará pelas obrigações e responsabilidades dos Estados conforme a Declaração Universal de Direitos Humanos e os Pactos Internacionais que a compõem, por serem estes a base do Sistema Universal de Proteção dos Direitos Humanos e conforme a Convenção Europeia de Direitos Humanos (principal documento do Sistema Europeu de Proteção e o qual se optou por focar o estudo) eis que, quando em tela direitos econômicos, sociais e culturais, essas obrigações internacionalmente assumidas, quando se trata de serem internamente implementadas traduzem-se em políticas públicas a serem promovidas pelos Estados. A caminhada encerrar-se-á, após a visita a alguns importantes institutos que influem tanto nas obrigações, quanto nas políticas públicas, como a Reserva do Possível, o Mínimo Existencial e ainda a Justiciabilidade dos direitos em tela e a Margem de Apreciação dos Estados, passando-se, então, à uma análise sobre o futuro dos direitos à educação e ao acesso à justiça dentro do Sistema Europeu de Proteção dos Direitos Humanos, tomando-se por base para tanto o Relatório sobre o futuro do Sistema Europeu de Proteção, elaborado em 2015 no âmbito do Tribunal Europeu de Proteção e assim, identificados serão alguns dos possíveis obstáculos futuros. | pt_PT |
| dc.description.abstract | It´s evident that as long as the societies evolve, new human rights are recognized and star to be part of a System of Protection. However, it´s mandatory to be aware of the effective protection and the availabitlity of these rights recognised as human rights, in special the education and the access to to justice, rights that are going to be the foundation of this research. The right to education, or more specifically, a human rights education is also a way to reach the access to justice, given that, in order for such acess that place effectively, legal education, not only for professional classes, but also for all citizens, is imperative. On the other hand, sometimes, only throught the right of access to justice that the right to education can be reached. Thereby, the present research, intents to go through the States obligations and responsabilities among the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights and the International Covenant on Economic, basis of the Universal System of Protection Human Rights, but also in accordance with the European Convention on Human Rights (the most important document of the European System of Human Rights Protection and the one chosen to be focused through the next pages), just because when it comes to economic, social and cultural rights, the assumed international obligations, they might be internally implemented, what, most of the time, requires strategies of the States to promote public policies. However, this research will not be concluded if it doesn´t take a look at some relevant institutes that have a huge influence both in the states obligations and public policy like Possible Reserve, Minimum Existential, the Justiciability of the rights in highlights and the Margin of Appreciation of the States. After taken these elements in account, it might be analyzed the future of the rights to education and the access to justice in the European System of Protection of Human Rights and it´s CDDH Report on the longer-term future of the System of the European Convention on Human Rights, published in 2015, document that helps to identify some of the obsticles that the future holds. | pt_PT |
