Abstract(s)
A presente Dissertação é realizada no âmbito do Mestrado em Direito e Prática Jurídica, na especialidade em Direito dos Transportes, com vista à obtenção do grau de Mestre e tem como principal objetivo a análise do regime das viagens organizadas no escopo do Direito Aéreo, abordando-se, essencialmente, o regime jurídico plasmado no Decreto-Lei n.º 17/2018, de 08 de março, atualmente em vigor, com especial enfoque no regime da responsabilidade civil das agências de viagens e turismo, mormente, a responsabilidade objetiva.
Antes de mais, e dada a pertinência e contexto, procurar-se-á fazer um percurso legislativo pelos principais diplomas que regeram a matéria, nomeadamente, a Convenção de Internacional sobre Contratos de Viagem (CCV), assinada em Bruxelas a 23 de abril de 1970 e, depois, a Diretiva 90/314/CEE, do Conselho, de 13 de junho de 1990, relativa às viagens organizadas, férias organizadas e circuitos organizados, esta última enquanto diploma que serviu de base às regulações posteriores e que aqui é também abordada.
A Dissertação tem um carácter, essencialmente, expositivo, mas não deixa de analisar, de forma crítica, as principais soluções adotadas pelo legislador, quer no âmbito dos diplomas europeus, quer nacionais. Por essa razão, e atendendo à natureza e carácter do contrato de viagem organizada, tornou-se imperativo fazer o necessário enquadramento com o Direito do Consumo, nomeadamente, suscitando-se a pertinente dúvida se o viajante, enquanto sujeito que adquire serviços, não poderá ser considerado um consumidor à luz da Lei da Defesa do Consumidor. Igualmente relevante se tornou também o cruzamento com a matéria relacionada com o regime das Cláusulas Contratuais Gerais (RGCCG).
Por fim, e atendendo que o Decreto-Lei n.º 17/2008, de 08 de março não se é passível de aplicação isolada, procedeu-se ao enquadramento do mesmo com o Regulamento 261/2004 do Parlamento Europeu e do Conselho, de 11 de Fevereiro de 2004, explicitando-se como é que ambos os diplomas se articulam entre si.
This Dissertation is carried out within the scope of the Master's Degree in Law and Legal Practice, specializing in Transport Law, with a view to obtaining a Master's degree and its main objective is to analyze the regime of organized travel within the scope of Air Law, addressing it essentially, the legal regime set out in Decree-Law n.º 17/2018, of March 8, currently in force. First of all, and given the relevance and context, an attempt will be made to take a legislative route through the main diplomas that governed the matter, namely, the International Convention on Travel Contracts (CCV), signed in Brussels on April 23, 1970 and, later, Council Directive 90/314/CEE, of June 13, 1990, relating to organized travel, packaged holidays and organized tours, the latter being a diploma that served as the basis for subsequent regulations. The Dissertation is essentially expository in nature, but it does not fail to critically analyze the main solutions adopted by the legislator, whether within the scope of European or national diplomas. For this reason, and taking into account the nature and character of the organized travel contract, it has become imperative to make the necessary framework with Consumer Law, namely, raising the pertinent doubt whether the traveler, as a subject who purchases services, cannot be considered a consumer in light of the Consumer Protection Law. Equally relevant was the intersection with matters related to the General Contractual Clauses (RGCCG) regime. Finally, and considering that Decree-Law n.º 17/2008, of March 8, cannot be applied in isolation, it was framed with Regulation 261/2004 of the European Parliament and of the Council, of February 11, 2004, explaining how both diplomas are linked to each other.
