Estamos vivendo em uma era onde a comunicação e o compartilhamento de dados acontecem por diversos meios e plataformas. Uma verdadeira revolução tecnológica que além de muitos benefícios para a vida em sociedade, traz desafios para múltiplas esferas em nosso cotidiano. É neste cenário que este trabalho objetiva apontar quais as soluções jurídicas com respeito aos limites da tutela da privacidade nos casos de provas colhidas em meios digitais. Precisamos de saídas precisas para garantir a privacidade em um sistema global digital que não possui fronteiras materiais. Ao mesmo tempo, não podemos deixar obsoletos os ditames acerca do processo penal para provas colhidas no universo digital, principalmente no que concerne às big techs, que são as grandes corporações como WhatsApp, Telegram, Google e Facebook. Este trabalho é fruto de uma revisão de literatura no âmbito do direito processual penal e do direito constitucional onde a discussão sobre direitos fundamentais e provas no âmbito digital são cruciais. Também foi realizada uma revisão legislativa em diplomas como o Projeto de Lei nº 2.630/2020 (PL das Fake News); Lei nº 12.965/2014 (Marco Civil da Internet) e Projeto de Lei de proteção de dados pessoais para fins exclusivos de segurança do Estado, de defesa nacional, de segurança pública, e de investigação e repressão de infrações penais. Apurou-se que a principal saída para conseguir dissolver ou reduzir a problemática é a revisitação de diplomas que já existem e conclusão de outros como a Lei Geral de Proteção de Dados Penal, além da criação de níveis de interferência estatal no âmbito da privacidade dos indivíduos. Os resultados da discussão buscam contribuir para reflexões também acerca do Estado Democrático de Direito.
We are living in an era where communication and data sharing happen through different means and platforms. A true technological revolution that, in addition to many benefits for life in society, brings challenges to multiple spheres in our daily lives. It is in this scenario that this work aims to point out the legal solutions regarding the limits of privacy protection in cases of evidence collected in digital media. We need precise outputs to ensure privacy in a digital global system that has no material borders. At the same time, we cannot leave the dictates regarding criminal proceedings for evidence collected in the digital universe obsolete, especially with regard to big tech, which are large corporations such as WhatsApp, Telegram, Google and Facebook. This work is the result of a literature review within the scope of criminal procedural law and constitutional law where the discussion on fundamental rights and evidence in the digital sphere are crucial. A legislative review was also carried out in diplomas such as Bill nº 2,630/2020 (Fake News` PL); Law No. 12,965/2014 (Civil Rights Framework for the Internet) and Bill on the protection of personal data for the exclusive purposes of State security, national defense, public security, and the investigation and repression of criminal offenses. It was found that the main solution to be able to dissolve or reduce the problem is the revisiting of diplomas that already exist and the conclusion of others such as the General Criminal Data Protection Law, in addition to the creation of levels of state interference in the scope of individuals' privacy. The results of the discussion also seek to contribute to reflections on the Democratic Rule of Law.
