A presente tese pretende comentar sobre os desenvolvimentos metodológicos da escolástica medieval até o século XVI – especificamente, pretendemos considerar a dialética escolástica como ferramenta metodológica para analisar as obras de Francisco de Vitória e Francisco Suarez, notadamente no âmbito das teorias semióticas medievais (expostas por autores como Abelardo, Ochkam, Duns Scoto e Margalho), e desta análise afirmar ou negar a influência da escolástica na racionalização de conceitos jurídicos desenvolvidos pelos referidos autores. Além disso, pretendemos analisar os desenvolvimentos metodológicos ocorridos na transição da metodologia aristotélico-dialética medieval para a metodologia empirista-indutiva derivada do jusracionalismo, em particular sob o pensamento de Francisco Vitória e Francisco Suarez. A análise proposta é ainda hoje relevante do ponto de vista jurídico e metodológico, notadamente devido a certas opiniões equivocadas construídas sobre a lógica medieval que chegaram até nossos dias, e que podem ser atribuídas ao humanismo e à reação reformista contra o método aristotélico-escolástico.
The present thesis intends to comment about the methodological developments of the medieval scholasticism until the 16th century – specifically, we intend to consider the scholastic dialectics as the methodological tool to analyze the works of Francisco de Vitória and Francisco Suarez, notably in view of medieval semiotic theories (expound by authors such as Abelardo, Ochkam, Duns Scoto and Margalho) and from this analysis to affirm or deny the influence of scholasticism in the rationalization of legal concepts developed by the aforementioned authors. Furthermore, we intend to analyze the methodological developments set along the transition from the medieval aristotelian-dialectic methodology to the empiricist-inductive methodology derived from jusrationalism, in particular under the thought of Francisco Vitória and Francisco Suarez. The proposed analysis is even today relevant from both legal and methodological standpoints, notably due to certain mistaken opinions construed about medieval logic that have reached our times, and which can be attributed to the humanism and the Reform reaction against to the Aristotelian-scholastic method.
