A presente dissertação tem como objetivo analisar a figura do crédito compensatório, previsto no n.º 2 do artigo 1676.º do Código Civil. Assim, iremos densificar o conceito de crédito compensatório, refletindo sobre a sua natureza jurídica e o seu fundamento e o modo como o mesmo está relacionado com os deveres conjugais e com a sua eventual violação.
Com esse intuito, far-se-á uma breve análise histórica, no geral, sobre a evolução do instituto do divórcio em Portugal e, em concreto, sobre a forma como as alterações legislativas inseridas pela Lei n.º 496/77, de 25 de novembro, e pela Lei n.º 61/2008, de 31 de outubro, impactaram na consagração do crédito compensatório a ex-cônjuges no ordenamento jurídico nacional. Esta análise implicará breves considerações sobre a evolução dos direitos dos cônjuges, nomeadamente dos direitos das mulheres, e o modo como as mudanças sociais que observámos, sobretudo desde a Revolução de 1974, impactam na forma como a figura deverá ser perspetivada.
Para além disso, analisaremos de forma critica os atuais requisitos previstos na lei para a atribuição do crédito. Deste modo, iremos tentar densificar os diversos conceitos indeterminados que compõe a norma em estudo, aplicando esses conceitos a alguns exemplos práticos.
Por fim, no último capítulo da presente dissertação, constam algumas propostas que visam colmatar algumas das críticas realizadas durante o seu desenvolvimento, pois a atual norma prevista carece de aplicabilidade prática, devido à sua complexidade e indeterminação.
The aim of this dissertation is to analyse the concept of compensatory credit, as set out in Article 1676(2) of the Civil Code. Thus, we will densify the concept of compensatory credit, reflecting on its legal nature and foundation and how it is related to marital duties and their possible violation. To this end, a brief historical analysis will be made, in general, of the evolution of the institute of divorce in Portugal and, specifically, of how the legislative changes introduced by Law no. 496/77, of 25 November, and Law no. 61/2008, of 31 October, impacted on the enshrinement of compensatory credit for ex-spouses in the national legal system. This analysis will involve brief considerations on the evolution of spouses' rights, particularly women's rights, and how the social changes we have seen, especially since the 1974 Revolution, have had an impact on the way the figure should be viewed. In addition, we will critically analyse the current requirements set out in the law for granting credit. In this way, we will try to densify the various undetermined concepts that make up the rule under study, applying these concepts to some practical examples. Finally, the last chapter of this dissertation contains some proposals aimed at remedying some of the criticisms made during its development, since the current rule lacks practical applicability due to its complexity and indeterminacy.
