A actividade do intĆ©rprete de normas ambientais, para alĆ©m de incluir a generalidade dos mĆ©todos e princĆpios hermenĆŖuticos tradicionais, insta ainda Ć equação de uma hermenĆŖutica especial de viĆ©s ambiental que permite uma maior adequação Ć s caracterĆsticas muito próprias da questĆ£o ambiental e uma maior efectividade do direito ambiental. assim, para a edificação e sedimentação de um estado de direito democrĆ”tico ambiental, importam os princĆpios gerais de direito ambiental, a estruturação multi-nĆvel da legislação ambiental e o papel fundamental da transformação informal do direito ambiental na hermenĆŖutica. a sustentabilidade e a integração conferem uma perspectiva holĆstica e sistĆ©mica que obriga a fugir Ć simples interpretação literal e promove uma ponderação de proporcionalidade entre os pilares ambiental, económico, social e cultural do desenvolvimento sustentado que afaste prĆ©- compreensƵes e wishful thinkings tĆ£o frequentes em interpretaƧƵes demasiado engajadas (e por isso incorrectas e inefectivas) das regras ambientais
The activity of the environmental norms interpreter, in addition to including most traditional hermeneutic methods and principles, also calls for a special hermeneutics with an environmental bias that allows for greater adaptation to the very specific characteristics of the environmental issue and greater effectiveness of the environmental law. Thus, for the construction and sedimentation of a democratic environmental Rule of law, the general principles of environmental law, the multi-level structuring of environmental legislation and the fundamental role of the informal transformation of environmental law in hermeneutics matter. Sustainability and integration provide a holistic and systemic perspective that forces us to escape simple literal interpretation and promotes a proportional balance between the environmental, economic, social and cultural pillars of sustained development, removing pre- understandings and wishful thinking so frequent in interpretations too engaged (and therefore incorrect and ineffective) of environmental rules.
