Abstract(s)
Esta dissertação analisa a função do nexo de causalidade enquanto instrumento fundamentador da responsabilidade civil extracontratual objetiva. A partir da demonstração da individualidade do fator objetivo da obrigação de indenizar, não mais compreendido como um apêndice ou uma simples exceção à responsabilidade civil subjetiva, afirma-se a necessidade de construção de um paradigma dogmático
próprio. É este o foco do primeiro capítulo do estudo, centrado nas alterações socioeconômicas que impulsionaram a evolução histórica da responsabilidade civil objetiva, bem como as relevantes alterações enfrentadas pelo modelo da culpa. No segundo capítulo, aponta-se o nexo de causalidade como o elemento comum às distintas manifestações do fator objetivo de responsabilidade, surgindo a teoria da imputação objetiva como o critério adequado para, afastando-se da perspectiva naturalística, construir um instrumento dogmaticamente coerente e axiologicamente justo para a atribuição do dever de indenizar.
This dissertation analyzes the causal link as the proper instrument for managing strict liabily in torts. After asserting the autonomy of strict liabily, no longer understood as a simple exception to the neglicence rule, it is clear the necessity to build an independent theory. The firts chapter focuses on the socioeconomic changes that drove the historical evolution of strict liability, as well as the changes seen in the negligence model. In the second chapter, the causal link is pointed out as a common element to the different manifestations of the objective factor of responsibility, with the objective imputation theory emerging as the appropriate criterion for building a dogmatically coherent and ethically fair instrument for the application of torts, oblivious to the factual perspective of the causal analysis.
