Abstract(s)
Este trabalho tem como objetivo analisar a os parâmetros de evolução do direito à saúde no Brasil, refletindo sobre o histórico das Constituições brasileiras, bem como da Constituição de 1988. Demonstrando a conceituação histórica do que é saúde, torna-se necessário acrescentar esse estado ao conteúdo do direito, demonstrando os delineamentos constitucionais atuais, delimitando ainda, as características do direito à saúde, como um direito fundamental social. Analisa ainda, a aplicabilidade da norma e direito à saúde e sua natureza jurídica e a sua conformação com as leis infraconstitucionais. A pesquisa utiliza a metodologia documental, por meio de consultas bibliográficas, legislações e análises jurisprudenciais, demonstrar a evolução do direito e os dilemas atuais. Por fim, observa as perspectivas de efetivação da saúde, baseadas em um mínimo existencial na execução de políticas públicas, ressalvada a questão dos problemas financeiros, sob a alegação da reserva do possível. Ressalta, outrossim, que o direito à saúde no Brasil tem solução, não dependendo unicamente de vontade política, mas sim em uma atuação conjunta do Poder Executivo, Poder Judiciário, Ministério Público e a participação da sociedade, para a elevação do direito à vida e dignidade da pessoa humana.
This study aims to analyze the evolution of the parameters of the right to health in Brazil, reflecting on the history of Brazilian Constitutions and the Constitution of 1988. Demonstrating the historical conception of what health is, it becomes necessary to add content to this state of law, demonstrating the current constitutional designs, defining also the characteristics of the right to health as a fundamental social right. It also examines the applicability of the rule and the right to health and their legal nature and their conformity to the others laws. The research methodology utilizes documentary, bibliographic through consultation, legislation and case law analysis, demonstrate the evolution of the law and current dilemmas. Finally, says the prospects for effective health, based on a minimum existential implementation of public policies, except for the issue of financial problems, claiming the reservation as possible. It appears, moreover, that the right to health in Brazil has a solution, depending not only political will, but in a joint action of the Executive, the Judiciary, Prosecutors and society participation, to elevate the right to life and dignity the human person.
