| dc.description.abstract | O tema da Inteligência Artificial (IA) e seu impacto em Direito de Autor é atual e pertinente, mas ainda pouco desenvolvido na doutrina. Nestes termos, a presente dissertação justifica-se pela necessidade de análise aprofundada deste tema, devido à crescente produção de obras pela IA e consequente intervenção em direitos de autor. A problemática principal consiste em determinar como o sistema de Direito de Autor pode proteger as criações humanas face às obras produzidas pela IA. O objetivo deste estudo é compreender como as obras produzidas pela IA interferem em direitos de autor (em particular de índole patrimonial), avaliando os limites e requisitos de proteção e a possibilidade de imputar responsabilidade. As hipóteses levantadas incluem: a quem imputar responsabilidade pela interferência ilícita em direitos de autor, na sequência das obras produzidas pela IA? Como os titulares de direitos de autor (humanos) podem ver ressarcidos os valores patrimoniais diante de tais ilicitudes? A presente pesquisa tem por finalidade propor soluções que assegurem a proteção dos direitos patrimoniais, no âmbito do Direito de Autor, com enfoque na legislação da União Europeia (UE) e no Direito Português. Metodologicamente, optou-se pelo método hipotético-dedutivo, formulando hipóteses com base na análise da doutrina, jurisprudência e legislação em vigor. A estrutura do trabalho inclui: uma Introdução ao tema e à problemática; a Revisão doutrinária com o enquadramento e conceito de obra e requisitos de proteção; a Análise das implicações da IA em Direito de Autor; e a apresentação das Conclusões e Recomendações. | pt |
| dc.description.abstract | The subject of Artificial Intelligence (AI) and its impact on Copyright Law is current and pertinent but still underdeveloped in doctrine. In these terms, this dissertation is justified by the need to analyze this topic in depth, due to the growing production of works by AI and the consequent intervention in copyright. The main problem is to determine how the copyright system can protect human creations in the face of works produced by AI. The aim of this study is to understand how works generated by AI interfere with copyright (particularly property rights), assessing the limits and requirements of protection and the possibility of imputing liability. The hypotheses raised include: who should be held liable for unlawful interference with copyright as a result of works produced by AI? How can (human) copyright holders be compensated for their property values in the face of such illicit behavior? The purpose of this research is to propose solutions that ensure the protection of property rights within the scope of copyright, with a focus on European Union legislation and Portuguese law. Methodologically, we opted for the hypothetical-deductive method, formulating hypotheses based on an analysis of doctrine, case law and current legislation. The structure of the work includes: an Introduction to the subject and the problem; a Doctrinal Review with the framework and concept of work and protection requirements; an Analysis of the implications of AI in Copyright Law; and the presentation of Conclusions and Recommendations. | en |
