| dc.description.abstract | O presente tema visa desenvolver o confronto entre a liberdade humorística e o direito à honra, procurando compreender a génese e o modo de funcionamento de um fenómeno imensamente atual e as mais características implicações do seu exercício. Com base na vasta teoria socio-humanística hoje disponível, onde se aglomeram investigações muito detalhadas da faceta humorística da personalidade humana, e nos constantes aprofundamentos comparatísticos do tema, designadamente oriundos dos ordenamentos anglo-saxónicos, procurámos reter e explicar os principais traços de um possível direito ao humor, defendendo-se nessa linha uma estrutura dogmática autónoma para esta posição jurídica. Não esgotando certamente a panóplia de temas controversos que o humor suscita, abordamos aqueles que se mostram juridicamente mais complexos e, sobretudo, mais proeminentes na ordem social. Para acusar, na ótica do leitor, as nuances mais imediatas dos raciocínios testados, empreendemos um estilo marcadamente heurístico, adensando as interrogações e evitando, pela natureza do debate científico, encerrar problemas que exigem uma reflexão contínua. | pt |
| dc.description.abstract | This paper aims to explore the conflict between freedom of humor and the right to honor, seeking to understand the origins and functioning of an immensely current phenomenon and the most characteristic implications of its exercise. Based on the vast socio-humanistic theory available today, which brings together very detailed research on the humorous facet of human personality, and on the constant comparative studies of the topic, particularly those originating from Anglo-Saxon legal systems, we have sought to retain and explain the main features of a possible right to humor, defending an autonomous dogmatic structure for this legal position. Without exhausting the range of controversial topics that humor raises, we address those that are legally more complex and, above all, more prominent in the social order. In order to highlight, from the reader's perspective, the most immediate nuances of the reasoning tested, we have adopted a markedly heuristic style, deepening the questions and avoiding, due to the nature of scientific debate, closing issues that require continuous reflection. | en |
