Abstract(s)
Esta dissertação aborda um dos proeminentes temas da atualidade, qual seja, os serviços ecossistêmicos, ou serviços ambientais (designados, respectivamente, pelas siglas PSE e PSA), o mecanismo do pagamento por estes benefícios prestados pela natureza, o tratamento jurídico do tema a nível europeu (tratados internacionais e outros documentos com caráter de soft law ou mesmo de viés orientador) e nacional (a nível de Portugal e Brasil), além de avaliar de que forma o direito, investido em sua função promocional, pode contribuir na ampliação do debate e aprimoramento do tema, na condição de uma das mais importantes ferramentas de promoção da tutela ambiental. Outrossim, é feita uma correlação entre os instrumentos jurídicos e a manutenção da qualidade da biodiversidade e dos serviços dela decorrentes nos contextos da União Europeia e do Brasil, assim como estabelecer uma correlação com aspectos econômicos e sociais.
This thesis addresses one of the prominent themes of today, namely, ecosystem services, or environmental services (designated, respectively, by the acronyms PSE and PSA), the mechanism of payment for these benefits provided by nature, the legal treatment of the topic at the european level (international treaties and other soft law documents or even guiding bias) and national (at the level of Portugal and Brazil), in addition to assessing how the law, invested in its promotional function, can contribute to the expansion of the debate and improvement of the topic, as one of the most important tools for promoting environmental protection. Furthermore, a correlation is made between the legal instruments and the maintenance of the quality of biodiversity and the services resulting from it in the contexts of the European Union and Brazil, as well as establishing a correlation with economic and social aspects.
