Abstract(s)
O progresso civilizatório, tanto nas conquistas humanas no campo da ciência quanto na evolução dos relacionamentos comunitários, encontra nos direitos fundamentais da liberdade de expressão e de acesso à informação valores de extrema relevância para o desenvolvimento dos povos em uma perspectiva de
dignidade e inclusão democrática. Com o surgimento e expansão da rede mundial de computadores, esses direitos foram potencializados em escala global, provocando sensíveis e impactantes efeitos na sociedade e no Direito, o que atualmente é reconhecido no plano internacional por diversas normas que tratam do ciberespaço e da sua importância para a difusão do pensamento humano. Este trabalho, portanto, objetiva expor essa realidade pelas lentes do constitucionalismo moderno, com especial foco nas transformações que a internet promoveu no Brasil na área do pensamento jurídico, nos fluxos dos movimentos sociais e na atualização da legislação para reger as inovações do mundo virtual com relação à livre exposição de ideias e ao acesso amplo ao conhecimento. Serão analisadas as principais normas sobre a matéria introduzidas nos últimos anos, bem como decisões emblemáticas que passaram a nortear os atores jurídicos nas demandas relativas à internet e à expressão/informação. Ao final, serão expendidas considerações sobre os rumos que a liberdade de expressão e o direito à informação estão a tomar em nível global e no território brasileiro. A evolução do ciberespaço chegou. Resta refletir sobre em qual compasso o Direito evoluiu para acompanhar este novos tempos.
The civilizing progress, as much in human achievements in the field of science as in the development of community relationships, it is in the fundamental rights of freedom of expression and access to information highly relevant values for the development of peoples in a perspective of dignity and democratic inclusion. With the appearance and expansion of the World Wide Web, these rights were created on a global scale, bringing on sensitive and striking effects on society and the law, in which is currently recognized internationally by various standards dealing with cyberspace and its importance to the diffusion of human thought. This study, therefore, aims to expose this reality through the visions of modern constitutionalism, with special focus on the changes, that Internet has promoted in Brazil in the area of legal thought, among social movements and updating of legislation to rule the virtual world innovations according to the free exhibition of ideas and open access to knowledge. It will be analyzed the principals rules on the matter introduced in recent years, as well as emblematic decisions that have guided the legal actors in the request on the internet and expression / information. At the end, the considerations will be issued on the directions that the freedom of expression and the right to information are taking on a global level and in Brazil. The evolution of cyberspace came. It remains to ponder in which the law has evolved compass to accompany this new time.
