Segurança Social : a integração da CPAS como regime complementar

Abstract(s)
O presente estudo tem por objeto um “sistema privado” de proteção social que abrange uma larga franja da população (cerca de sessenta mil profissionais), pretendendo chegar a uma solução que assegure a concretização dos princípios da igualdade da proteção social, da capacidade contributiva e do equilíbrio intergeracional, uma vez que as contribuições destes profissionais não são calculadas com base na sua real capacidade contributiva, e que o seu sistema se tem revelado muito reticente ao nível de prestação de medidas assistencialistas adequadas, tanto na atual crise bem como em todos os momentos em que estes profissionais se encontram numa situação mais débil. Assim sendo, iremos fazer a comparação dos regimes nacionais de proteção social aplicados, respetivamente, aos trabalhadores abrangidos pelo Sistema da Segurança Social e dos profissionais vinculados à Caixa de Previdência dos Advogados e Solicitadores.
Todavia, é premente ter consciência de que, mais do que nunca, a sustentabilidade da Segurança Social, está a ser posta em causa, pois a presente crise de saúde veio agravar a capacidade de obtenção de receitas, tendo exigido a aplicação de medidas de caráter assistencialista e o uso do fundo de estabilidade. Neste prisma, é imperativo que estudemos a hipótese de integração da CPAS na Segurança Social, tendo em consideração os direitos adquiridos, o envelhecimento populacional e a sustentabilidade desta solução a médio e longo prazo. Por outro lado, iremos estabelecer uma comparação entre a Caixa da Previdência dos Advogados e dos Solicitadores com o Regime de Proteção Social aplicável aos advogados brasileiros.
The present study has as its object a "private system" of social protection that covers a wide range of the population (about sixty thousand professionals), aiming to arrive at a solution that ensures the realization of the principles of equality of social protection, of the ability to pay and of the intergenerational balance, since the contributions of these professionals are not calculated based on their real contributory capacity, and that their system has proved to be very reticent in terms of providing adequate assistance measures, both in the current crisis and in all moments when these professionals find themselves in a weaker situation. Therefore, we will compare the national social protection schemes applied, respectively, to workers covered by the Social Security System and professionals linked to the Caixa de Previdência dos Advogados e Solicitador. However, it is urgent to be aware that, more than ever, the sustainability of Social Security is being called into question, as the current health crisis has worsened the ability to obtain income, requiring the application of measures of a assistance and the use of the stability fund. From this perspective, it is imperative that we study the possibility of integrating the CPAS into Social Security, taking into account acquired rights, population aging and the sustainability of this solution in the medium and long term. On the other hand, we will establish a comparison between Caixa da Previdência dos Advogados e Solicitadores and the Social Protection Regime applicable to Brazilian lawyers.
