A regulação das situações de conflito de interesses tornou-se um imperativo globalmente emergente. No âmbito do Direito Administrativo, a prossecução do interesse público, aliada à tutela da confiança dos cidadãos na atuação da administração pública, impõe a superação do enquadramento tradicional centrado exclusivamente no princípio da imparcialidade, exigindo a sua articulação com outros princípios jus-administrativos, em especial com uma renovada conceção do princípio da boa administração. O Direito Administrativo português tem trilhado um caminho progressivo na regulação dos conflitos de interesses no exercício da função administrativa pública. O presente estudo propõe-se analisar esse percurso, identificar experiências relevantes de outros ordenamentos jurídicos e contribuir para a reconfiguração dos princípios subjacentes, bem como para a sistematização das normas aplicáveis à regulação dos conflitos de interesses.
The regulation of conflicts of interest has become a globally emerging imperative. In the field of Administrative Law, the pursuit of the public interest, together with the safeguarding of citizens’ trust in the actions of public administration, calls for a Shift beyond the traditional framework centered solely on the principle of impartiality. It requires a broader articulation with other principles of administrative law, in particular a renewed understanding of the principle of good administration. Portuguese Administrative Law has progressively developed its approach to the regulation of conflicts of interest within the exercise of public administrative functions. This study aims to analyze that development, examine relevant experiences from other legal systems, and contribute to a reconfiguration of the underlying principles as well as to the systematization of the legal regulation of conflicts of interests.
