Homicídio no feminino e no masculino : uma análise da prática judiciária

O fenómeno da mulher como agente de um crime de homicídio é menos estudado e muito menos frequente, apesar da sua tendência de crescimento, quando comparada com a temática dos crimes de homicídio levados a cabo por uma pessoa do sexo masculino, uma vez que esta é apresentada, na maioria dos casos, como uma vítima. E é-o realmente, ao menos no caso dos homicídios em contexto de violência doméstica. Os fatores que dominam e designam o crime de homicídio não são, predominantemente, os mesmos para o homicídio no feminino e para o homicídio no masculino, pelo que é importante realizar uma análise, extensa, profunda e comparativa, sobre a prática judiciária nacional, de modo a percebermos se há desigualdades de género quando estamos perante estes dois tipos de agentes. Assim sendo, e para além deste estudo, será, ainda, crucial desenvolver o tema do populismo penal, na medida de determinarmos se, e como, é que este interfere com o decorrer de um processo, nomeadamente, na decisão judicial condenatória.
The phenomenon of women as an agent of a homicide crime is less studied and much less frequent, despite its tendency to grow, when compared to the theme of homicide crimes carried out by a male person, since it is presented, mostly cases, as a victim. And it really is, at least in the case of homicides in the context of domestic violence. The factors that dominate and designate the crime of homicide are not, predominantly, the same for homicide in the female and for homicide in the male, so it is important to carry out a through and comparative analysis of national judicial practice, in order to understand if there are gender inequalities when we are dealing with these two types of agents. Therefore, and in addition to this study, it will also be crucial to develop the theme of criminal populism, in order to determine if, and how, it interferes with the course of a process, namely, in the sentencing court decision.
