Pretender analisar a legitimidade normativa-existencial do amplo sistema de Justiça Militar demanda, obrigatoriamente, perpassar o contexto histórico, ainda que de modo sucinto, em que surgiram as instituições militares, verificar seus particulares princípios, deveres e restrições de direitos, para, alcançando as novas formas de conflitos armados e o atual cenário de emprego das Forças Armadas em diferentes frentes visando à garantia da segurança humana e democrática, compreender o papel da jurisdição dos crimes militares e o movimento mundial de reforma da sua conformação e da legislação pertinente.
Intending to analyze the normative-existential legitimacy of the broad system of Military Justice demands, necessarily, to go through the historical context, even if briefly, in which military institutions arose, to verify their particular principles, duties, and rights restrictions, in order to, reaching the new forms of armed conflicts and the current scenario of employment of the Armed Forces in different fronts aiming at the guarantee of human and democratic security, understand the role of the jurisdiction of military crimes and the global movement of reform of its conformation and pertinent legislation.
