Abstract(s)
Este trabalho de investigação centra-se no exame da dupla natureza do Poder Judiciário. A primeira liga-se diretamente à função jurisdicional, na resolução de conflitos submetidos ao devido processo legal judicial. A segunda diz respeito ao protagonismo e ao ativismo judiciais que vieram a se consolidar desde as três últimas décadas do século XX. No que respeita diretamente ao objeto de estudo e à questão investigativa que anima esta pesquisa científica, cruzam-se as funções Executiva e Judiciária, diretamente sobre o problema das políticas públicas de saúde. Debruça-se, portanto, sobre as decisões em que os magistrados brasileiros têm atuado para conferir efetividade e garantir o cumprimento das políticas públicas de saúde definidas em lei. Por essa razão, foram investigadas as justificativas de natureza axiológica das decisões judiciais sobre política pública, revelando que, ao ultrapassar os limites dos princípios gerais do Direito e adentrar valores da sociedade política, o Poder Judiciário atua como órgão de Poder, e não apenas como uma função de Estado.
This research work focuses on examining the dual nature of the judiciary. The first is causally linked to the judicial function, in the resolution of conflicts submitted to due judicial process. The second concerns the judicial protagonism and activism that have been consolidated since the last three decades of the 20th century. With regard directly to the object of study and the investigative issue that animates this scientific research, the Executive and Judicial functions are crossed, directly on the problem of public health policies. It focuses, therefore, on the decisions in which Brazilian magistrates have acted to ensure effectiveness and ensure compliance with public health policies defined by law. For this reason, the axiological justifications of judicial decisions on public policy were investigated, revealing that, by exceeding the limits of the general principles of law and entering into values of political society, the Judiciary acts as a body of power, and not only as a function of state.
