O presente texto corresponde à arguição realizada nas provas públicas de doutoramento de Rui Alberto de Figueiredo Soares, que tiveram lugar na reitoria da Universidade de Lisboa no dia 13 de fevereiro de 2020. O presente texto incide sobre os temas: (i) relação obrigacional complexa e qualificação das situações jurídicas emergentes do contrato de empreitada; (ii) regime do incumprimento e respetivas consequências; (iii) questões diversas sobre o regime do contrato de empreitada.
The following text corresponds to the written version of the cross-examination of the Phd thesis in law – legal and civil sciences, presented by Felipe Teixeira Neto, concerning strict liability and damage, in which the author seeks to find an explanation in terms of grounds for strict liability, to select and clarify the respective requirements (in particular, the damage and the causal link) and even to propose a general regime of strict liability.
