Abstract(s)
A evolução do fenómeno da globalização mundial, assim como do turismo de massa em Portugal, tem proporcionado o desenvolvimento de novas atividades lucrativas, nomeadamente ilícitas, tal como é o caso da venda de falsos estupefacientes. Este novo “ramo de atividade” tem vindo a preocupar as populações das cidades nas quais se desenvolve, uma vez que a presença destes novos “traficantes” tem gerado um sentimento de insegurança nas referidas populações, mas não só.
Os próprios turistas são frequentemente abordados de forma insistente por vendedores de falsos estupefacientes, o que gera um sentimento de insegurança. Por esse motivo, um dos antigos vereadores da Câmara Municipal de Lisboa, Carlos Manuel Castro, em junho de 2015, propôs ao então Ministro da Administração Interna que fosse criminalizada a venda de falsos estupefacientes.
Todavia, tal projeto de enquadramento jurídico-penal não chegou, até hoje, a ser concretizado. Assim, propomo-nos a analisar quais os mecanismos legais que atualmente estão à disposição do julgador português para apreciar juridicamente este tipo de conduta e a sua eficácia, bem como a viabilidade de uma eventual inserção no ordenamento jurídico português de uma nova norma criminal que puna específica e concretamente a venda de falsos estupefacientes.
The evolution of the phenomenon of globalization worldwide, as well as mass tourism in Portugal, has led to the development of new profitable activities, particularly illicit ones, such as the sale of fake drugs. This new “branch of activity” has been worrying the populations of the cities in which it is developed, since the presence of these new “traffickers” has generated a feeling of insecurity among these populations, as well as in other individuals. In fact, tourists themselves are often insistently approached by sellers of fake drugs, which creates a feeling of insecurity. For this reason, one of the former councillors of the Lisbon City Council, Carlos Manuel Castro, in June of 2015, proposed to the then Minister of Internal Administration that the sale of fake drugs should be criminalized. However, this criminal legal framework project has not yet been implemented. Therefore, we propose to analyse which legal mechanisms are currently available to the Portuguese judge to legally assess this type of conduct and its effectiveness, as well as the feasibility of a possible insertion into the Portuguese legal system of a new criminal norm that punishes specifically the sale of fake drugs.
