Hoje em dia, a persistência da desigualdade de tratamento com base no género, bem como violações generalizadas de direitos humanos de mulheres e crianças, são uma realidade. Mediante, análise de instrumentos regionais e internacionais de promoção e proteção dos Direitos Humanos, a presente dissertação tem como objetivo estudar a garantia do direito à habitação de mulheres e crianças, especificamente nos casos de violência doméstica, maus-tratos e abusos. Deste modo, é fulcral estudar a efetivação do direito à habitação e salientar as lacunas entre os princípios e a realidade enfrentada pelos grupos vulneráveis em questão. O principal objetivo é analisar e compreender o impacto social dessas questões, enfatizando a conexão entre a falta de proteção do direito à habitação com as consequências adversas enfrentadas pelas vítimas de violência doméstica, maus-tratos e abusos, com um olhar específico sobre o caminho que as pode levar à situação de sem- -abrigo, assim como as respostas sociais e legais existentes, em Portugal.
Nowadays, the persistence of unequal treatment based on gender, as well as widespread violations of the human rights of women and children, are a reality. Through the analysis of regional and international instruments for the promotion and protection of Human Rights, this thesis aims to study the guarantee of the right to housing for women and children, specifically in cases of domestic violence, family mistreatment and abuse. In this sense, it is essential to study the implementation of the right to housing and highlight the gaps between the principles and the reality faced by the aforementioned vulnerable groups. The main objective of the thesis is to analyse and understand the social impact of these issues, emphasizing the connection between the lack of protection of the right to housing and the adverse consequences faced by victims of domestic violence, family mistreatment and abuse, with a specific look at the path that can lead them to homelessness, as well as existing social and legal remedies in Portugal.
