A problemática do controle estadual sobre as sentenças arbitrais estrangeiras é dos temas que mais desperta a atenção dos estudiosos do DIP mormente da arbitragem, visto que é dos temas com maior impacto sobre o desenvolvimento da arbitragem. A existência de um equilíbrio entre o controle estadual e o respeito da autodeterminação das partes manifestada na convenção da arbitragem, é vital para aprimoramento da arbitragem. A CNI de 1958 sobre o Reconhecimento e a Execução de Sentenças Arbitrais Estrangeiras, em vigor em Portugal desde 1995, é o maior instrumento internacional multilateral de estandardização internacional do sistema de controle estatal sobre a observância do devido processo e da ordem pública internacional do Estado ad quem. De 1958 a esta parte, continua patente as necessárias reflexões sobre algumas questões vitais acerca do reconhecimento e de execução das sentenças arbitrais estrangeiras, cujas discussões ainda por finalizar. A ordem pública prevista nos arts. Vº/2 al. b) da CNI e 56º/. al. b) ii da LAVP, é uma dessas questões que suscitam debates quer ao nível das doutrinas, quer ao nível das jurisprudências.
Ponderada a incerteza que o instituto introduz no sistema, releva para o efeito do controlo estadual, a violação das normas e princípios estruturantes do Estado do foro - ordem pública internacional. Verificada a adequada conexão, a sua concretização, deve limitar-se ao resultado a produzir pela sentença a reconhecer, que tende de violar de forma flagrante, efetiva e concreta à ordem pública internacional do foro. Dada a sua importância na conservação dos valores básicos dos Estados e a sua imprecisão, não cremos que a futura revisão poderá vir a removê-la dos fundamentos de recusa e nem desanuviará os termos da sua concretização. Ela é, dessa forma, um mal sem remédio e, portanto, um mal necessário para conservação dos valores básicos de cada comunidade.
The issue of state control over foreign arbitral awards is one of the topics that most attracts the attention of scholars of DIP, especially arbitration, since it is one of the topics with the greatest impact on the development of arbitration. The existence of a balance between state control and respect for the self-determination of the parties manifested in the arbitration agreement is vital for the improvement of arbitration. The 1958 CNI on the Recognition and Enforcement of Foreign Arbitral Awards, in force in Portugal since 1995, is the largest multilateral international instrument for the international standardization of the system of state control over the observance of due process and international public order of the adjoining State. who. From 1958 to this part, the necessary reflections on some vital issues concerning the recognition and enforcement of foreign arbitral awards, whose discussions have yet to be concluded, continue to be evident. The public order provided for in arts. Vº/2 al. b) of the CNI and 56th/. al. b) ii of the LAVP, is one of those issues that give rise to debates both at the level of doctrines and at the level of jurisprudence. Considering the uncertainty that the institute introduces into the system, for the purpose of state control, the violation of the norms and structuring principles of the State of the forum - international public order. Once the appropriate connection is verified, its implementation must be limited to the result to be produced by the sentence to be recognized, which tends to violate in a flagrant, effective and concrete way the international public order of the forum. Given its importance in preserving the basic values of the States and its imprecision, we do not believe that the future review will be able to remove it from the grounds for refusal, nor will it clear up the terms of its implementation. It is, therefore, an incurable evil and, therefore, a necessary evil for the conservation of the basic values of each community.
