A presente pesquisa teve por objetivo fazer uma análise a respeito da proteção dos Direitos Humanos das Mulheres pelo sistema europeu de proteção dos Direitos Humanos. Teve como foco os casos de violência doméstica, fazendo um paralelo da jurisprudência do Tribunal Europeu de Direitos Humanos e os instrumentos internacionais que enumeram, promovem e garantem os Direitos Humanos das Mulheres. Durante séculos as mulheres vêm lutando para que sejam reconhecidas como sujeitos detentores de direitos e deveres, contra a discriminação de gênero e desigualdade de direitos, e pela garantia de poder gozar de forma plena desses direitos específicos. Apesar de avanços com a criação de legislações internacionais de proteção, promoção e garantia dos Direitos Humanos das Mulheres, as violações ainda são uma realidade difícil de combater e a violência doméstica perpetrada por parceiros e ex-parceiros ganha um peso maior por ser a mais usual. A origem e o fundamento dessa violência possuem raízes profundas. Ao longo dos anos foi formado um pensamento de que existia uma hierarquia entre os gêneros, fazendo com que as mulheres fossem consideras seres inferiores e naturalizando a violência contra elas. O papel das cortes internacionais no combate a essas violações tem sido primordial na tentativa de modificar a situação e trazer um maior bem-estar para as mulheres. A metodologia utilizada nessa pesquisa se deu com a revisão e análise de livros, artigos, periódicos, revistas cientificas e Instrumentos jurídicos internacionais. A jurisprudência analisada deu suporte ao desenvolvimento da pesquisa que está disposta em três seções. Na primeira seção, foi feito um levantamento de como ao longo dos séculos as mulheres vêm lutando para serem reconhecidas como sujeitos detentores de direitos, por meio de movimentos internacionais, como o Feminismo, e como ainda não gozam de forma plena desse status. Fazemos uma análise do reconhecimento dos Direitos Humanos das Mulheres e suas violações. Na segunda seção, voltamos nossa pesquisa para a violência doméstica fazendo uma análise de conceitos procurando entender suas raízes. Na terceira seção fizemos uma análise qualitativa e analisamos, por meio de julgados do Tribunal Europeu de Direitos Humanos, como parte do sistema europeu de proteção aos Direitos Humanos, vem se posicionando sobre o tema da violência doméstica contra as mulheres, verificando avanços e apontando deficiências.
The aim of this research was to analyze the protection of women's human rights by the European Court of Human Rights’ protection system. It focused on cases of domestic violence, drawing a parallel between the case law of the European Court of Human Rights and the international instruments that list, promote and guarantee women's human rights. Over the centuries, women have fought to be recognized as subjects with rights and duties, against gender discrimination and unequal rights, and to be guaranteed the full enjoyment of these specific rights. Despite the progress made with the creation of international legislation to protect, promote and guarantee women's human rights, violations are still a reality that is difficult to combat and domestic violence perpetrated by partners and ex-partners is the most common. The origin and foundation of this violence has deep roots. Over the years, the idea that there was a hierarchy between the sexes was formed, leading women to be considered inferior beings and naturalizing violence against them. The role of international courts in combating these violations has been crucial in trying to change the situation and bring greater well-being to women across the planet, but we are still a long way from a solution to the problem. The methodology used in this research was a review and analysis of books, articles, periodicals, scientific journals and international legal instruments. The case law analyzed supported the development of the research, which is divided into three sections. In the first section, we survey how women have struggled over the centuries to be recognized as subjects with rights, through international movements such as Feminism, and how they still do not fully enjoy this status. We analyze the recognition of women's human rights and their violations. In the second section, we turn our research to domestic violence, analyzing concepts in an attempt to understand its roots. In the third section, we carried out a qualitative analysis and looked at the judgments of the European Court of Human Rights to see how part of the European system for protecting human rights has positioned itself on the issue of domestic violence against women, verifying progress and pointing out shortcomings.
