O desenvolvimento da comunicação está intrinsecamente ligado à expressão criativa do ser humano que, incluído em um dado contexto social, expressa a suas mais variadas habilidades de acordo com os meios que lhe estão disponíveis no momento histórico. A invenção da prensa por Johannes Gutenberg tornou possível a reprodução em larga escala e maior distribuição de obras, tornando necessária a regulação jurídica da atividade de impressão de obras. Há tempos atrás, os meios de comunicação social eram claramente demarcados entre si, sendo possível identificar principalmente a imprensa escrita, a rádio e a televisão. Entretanto, a Internet propiciou a convergência dos meios de comunicação, possibilitando concentrar, em um único dispositivo tecnológico, a imagem e som e várias outras funcionalidades. Deste modo, o fenômeno da convergência dos meios de comunicação social pode ser entendido como a progressiva fusão dos meios de comunicação social tradicionais com a Internet. Para acolher uma nova tecnologia que impacta as formas de utilização das obras literárias ou artísticas o sistema de proteção do direito de autor tem passado por atualizações. E em decorrência da preocupação de esvaziamento do seu conteúdo, nos últimos anos verificou-se uma incessante intervenção legislativa no sistema de Direito de Autor voltada quase exclusivamente para o fortalecimento da tutela do direito patrimonial do titular do direito de autor. Entretanto, a expansão do âmbito dos direitos intelectuais, acompanhada por um reforço constante dos poderes assegurados aos titulares acarreta a redução dos limites dos direitos intelectuais e, consequentemente, o espaço de liberdade sofre restrições. Contudo, numa Sociedade da Informação será necessário refletir sobre o exclusivo do autor.
The development of communication is intrinsically connected to the creative expression of the human being, inserted in a certain social context, express their most variable abilities according with the available means in a historical moment. The invention of the printing press by Johannes Gutenberg made possible the large-scale reproduction and greater distribution of works, making necessary the legal regulation of the printing activity. A while ago, the means of social communication were clearly demarcated between each other, being possible to identify mainly the written press, radio and television. However, the Internet provided the convergence of means of communication, enabling the concentration in a single technological device image and sound and several other functionalities. In this way, the phenomenon of media convergence can be understood as the progressive merger of traditional media with the Internet. In order to accommodate a new technology that impacts the ways in which literary or artistic works are used, the copyright protection system has gone through updates. And as a result of the concern to empty the content of copyright, the incessant legislative intervention in recent years in the Copyright system has focused almost exclusively on strengthening the protection of the patrimonial right of the holder of the copyright. However, the expansion of the scope of intellectual rights, accompanied by a constant reinforcement of the powers assured to the holders, leads to the reduction of the limits of intellectual rights and, consequently, the space of freedom suffers restrictions. Nonetheless, in an Information Society it it will be necessary to reflect on the Author's Exclusive Rights.
