O presente artigo incide sobre a acção de reconhecimento da existência de contrato de trabalho, ponderando as recentes alterações legislativas e evolução jurisprudencial. Em especial, analisa a particular posição do trabalhador nesta acção, as respectivas regras de tramitação, bem como alguns problemas específicos que se podem colocar no seu âmbito, nomeadamente, quanto à delimitação dos efeitos da acção.
This article addresses the judicial procedure for recognition of the existence of an employment contract, reflecting on recent legislative changes and developments in case law. In particular, it analyses the special position of the employee in this judicial procedure, the respective rules of procedure, as well as some problems that may arise within its scope, namely regarding the delimitation of its effects.
