O presente trabalho analisou o direito à saúde dos migrantes no direito internacional, e em especial a questão da expulsão de migrantes que necessitem de particulares cuidados de saúde. A pesquisa investigou como os instrumentos jurídicos internacionais que garantem os Direitos Humanos estão inseridos na legislação interna para garantia do direito à saúde dos migrantes. Havendo migrantes regulares e irregulares, no que respeita à sua permanência perante o Estado de acolhimento, os segundos encontram-se em situação de maior vulnerabilidade quanto ao direito de acesso a cuidados públicos de saúde. E poderão ainda enfrentar restrições acrescidas de entrada e permanência, designadamente quando sejam portadores de doenças infecciosas, ou serem expulsos mesmo quando tenham doenças graves ou enfrentem até risco de vida. Desse modo, buscou-se analisar a jurisprudência especialmente dos Tribunais Regionais quando está em causa a expulsão do migrante, e essa expulsão representar um risco real de maus-tratos, tortura, penas, ou tratamento desumano ou degradante. O Tribunal Europeu do Direito do Homem é pioneiro nessa interpretação, e vem solidificando a sua jurisprudência. Por sua vez, a Corte Interamericana tem também abordado questões semelhantes, onde o direito à saúde conflitua com a soberania do Estado.
This study examined the right to health of migrants in international law, and in particular the question of the expulsion of migrants demanding special health cares. The research investigated how international legal instruments regarding Human Rights have been adopted in national legislation, in order to guarantee the right to health of migrants. There are regular and non-regular migrants, in what concerns with the statute of their stay upon the hosting State. The second ones are particularly vulnerable in the right of access to public health care, and the right in entering and staying may be even limited in case of infectious and contagious diseases. Moreover, they may be expelled even when they have their lives in risk due to very serious health conditions. Thus, we sought to examine the regional jurisprudence whenever the possible expulsion of a migrant is under question, and that expulsion may represent a real risk of ill-treatment, torture, feathers, inhuman or degrading treatment. The European Court of Human Rights is a pioneer in the interpretation of those issues, and has been consolidating its case-law. The Inter-American Court of Human Rights has also approached these complex issues, when the right to health is in conflict with a State sovereignty.
