A dissertação em comento busca contribuir para a rica e complexa discussão acerca dos efeitos sucessórios advindos da Procriação Medicamente Assistida post mortem. Para tanto far-se-á necessário adentrar na legislação geral portuguesa sobre o tema, a esmiuçando até adentrar na Lei nº 72/2021, de 12 de novembro. Com efeito, serão realizados apontamentos sobre o direito sucessório português para, finalmente, concluirmos acerca dos direitos sucessórios dos nascidos através das técnicas póstumas. O trabalho trará ainda olhares internacionais sobre a PMA post mortem, o que representa fonte de comparação e ideias legislativas.
The dissertation at hand seeks to contribute to the rich and complex discussion regarding the succession effects arising from Post-Mortem Assisted Reproduction. To do so, it will be necessary to delve into the general Portuguese legislation on the subject, analyzing it in detail until reaching Law no. 72/2021, of November 12. In fact, there will be notes on Portuguese succession law to ultimately conclude on the successions rights of those born through post-mortem techniques. The work will also provide international perspectives on Post-Mortem Assisted Reproduction, witch serves as a source for comparison and legislative ideas.
