A presente Dissertação visa demonstrar que a cumulação de partes (ativas e passivas) e a cumulação de pedidos podem relevar no plano da legitimidade do autor da ação para recorrer.
Terá como propósito entender a necessidade de a parte ser objetivamente afetada pela decisão, à luz do disposto no art.º 631º n.º 1 e 2 do atual CPC considerando algumas interpretações deste preceito na jurisprudência e na doutrina. Através da análise das orientações constantes de certos acórdãos poder-se-á reconhecer que existe uma tendência para restringir o direito ao recurso atribuído ao autor da ação, em função do tipo de cumulação de pedidos por ele efetuada. Importa analisar os efeitos desta tendência, o que a fundamenta, questioná-la e nomeadamente, identificando as suas contradições.
Explorar-se-ão as opiniões doutrinárias e jurisprudenciais mais relevantes, face à legitimidade ativa para interpor recursos, que decorram da existência simultânea na ação, de cumulação subjetiva (ativa), e de cumulação objetiva analisando várias situações de litisconsórcio e de coligação, e atendendo à cumulação simples, alternativa e subsidiária de pedidos. Em qualquer caso, o objeto principal desta tese será o aprofundamento dos desafios da qualificação de cumulação subjetiva subsidiária no processo, e, consecutivamente, a legitimidade para recorrer nestes cenários.
Para finalizar, e sintetizar os temas mais relevantes previamente abordados será analisado um acórdão, enquanto caso de estudo. Esse acórdão, que não reconhece às autoras legitimidade para recorrer, é especialmente relevante uma vez que trata de um caso de cumulação de partes, ativas e passivas, e cumulação de pedidos. Esse acórdão tem um voto vencido e o mesmo foi revogado pelo Supremo Tribunal de Justiça, que confirmou a posição do voto vencido.
The following dissertation aims to demonstrate that the Cumulation of parties (active and passive) and cumulation of claims, may impact the Plaintiff’s request to appeal from the sentence, by analyzing the eligibility to lodge an appeal. It will regard the necessity for a party to be objectively affected by the decision, considering the Article 631, paragraphs 1 and 2 of the current Portuguese Code of Civil Procedure. Through the analysis of the jurisprudence, it is possible to identify a notable trend to limit the plaintiff's Right to Appeal, based on the type of cumulation of requests. Which makes it important to analyze the underlying effects of this tendency, it’s fundamentals, and to question it, considering potential conflicts that it may occur. The most relevant doctrinal and jurisprudential opinions will be explored, contemplating the restrictions on the plaintiff's legitimacy to lodge appeals that result from the simultaneous existence of subjective (active) and objective cumulation in proceedings, analysing the various situations of joint venture and coalition, and considering the simple, alternative, and subsidiary cumulation of claims. Although it will delve deeper into the challenges of qualifying subsidiary subjective cumulation in the process and, consequently, the legitimacy of appealing in such scenarios. To conclude and summarise the most relevant topics previously covered, it will be analysed a ruling as a case study. This ruling stands out, by discussing a case of cumulation of parties, both active and passive, and cumulation of claims, which did not recognise the legitimacy of the plaintiffs to appeal. In this decision by the Court of Appeal, there was a losing vote, and it was subsequently overturned by the Supreme Court of Justice, which confirmed the losing vote’s stance.
