Abstract(s)
A ASAE é uma autoridade administrativa que regula a saúde alimentar e a actividade económica em Portugal sendo, para além disso, um órgão de polícia criminal. Está-lhe prevista por lei a faculdade de proceder a inspecções e a buscas.
Com o presente trabalho, pretende-se analisar o teor das inspecções, assim como o âmbito das buscas. O resultado destas, poderá ter influência no direito à não auto-incriminação, que é uma manifestação do princípio do nemo tenetur se ipsum accusare.
Por último, tentaremos perceber que problemas resultam das inspecções e buscas no seu relacionamento com o princípio nemo tenetur se ipsum accusare e apresentar uma solução satisfatória.
In Portugal, the food safety and the economic activities are supervised by ASAE. ASAE is, as well as an administrative authority, a criminal police corp. According to the law, ASAE is able to perform inspections and searches. We intend to analise the core of these proceedings. The proofs obtained by these means may collide with the privilege against self-incrimination. We shall try to present a satisfactory conclusion regarding the problems that arise from the confrontation between the nemo tenetur se ipsum accusare principle and the inspections and searches performed by ASAE
