Este trabalho tem como objeto a investigação sobre o papel dos tribunais nacionais na implementação do Direito Internacional do Ambiente, tomando-se por fio condutor a natureza complexa e dinĆ¢mica desse campo de estudo, em um cenĆ”rio de intensa e constante influĆŖncia das diversas realidades socioeconĆ“micas que lhe dĆ£o moldura. O reconhecimento de que a emergĆŖncia climĆ”tica constitui o zeitgeist da era em que vivemos e que suas diversas repercussƵes sĆ£o tambĆ©m constituintes de tais realidades Ć© visto na investigação como fator determinante para a amplificação da atuação dos tribunais nacionais no enfretamento de temas ambientais que jĆ” nĆ£o podem ser confinados por limites geogrĆ”ficos. O conceito e as funƧƵes da jurisprudĆŖncia sĆ£o tambĆ©m sinteticamente analisados, a fim de facilitar a compreensĆ£o sobre como a atividade julgadora repercute na vida jurĆdica de forma geral e, em especial, como essa repercussĆ£o pode ter lugar na seara do Direito do Ambiente. Trata-se, em seguida, dos entraves existentes para a implementação do Direito Internacional do Ambiente pelos tribunais nacionais, após o que sĆ£o apresentadas as justificativas para a atuação dessas cortes em um ramo jurĆdico do Direito Internacional. Por fim, sĆ£o apresentadas as diversas formas como os tribunais nacionais podem promover, direta e indiretamente, a implementação do Direito Internacional do Ambiente nos ordenamentos jurĆdicos internos.
This work aims to investigate the role of national courts in the implementation of International Environmental Law, taking as a guide the complex and dynamic nature of this field of study, whitin a scenario of intense and constant influence of the various socioeconomic realities that give it a frame. The recognition that the climate emergency constitutes the zeitgeist of the era in which we live and that its diverse repercussions are also constituents of such realities are seen in the investigation as a determining factor for the amplification of the role of national courts in tackling environmental issues that can no longer be confined by geographic boundaries. The concept and functions of jurisprudence are also synthetically analyzed, to facilitate understanding of how judging activity affects legal life in general and, in particular, how this impact can take place in the field of Environmental Law. Subsequently, the existing obstacles to the implementation of International Environmental Law by national courts are analized, after which justifications are presented for the action of these courts in a legal branch of International Law. Finally, the various ways in which national courts can promote, directly and indirectly, the implementation of International Environmental Law in domestic legal systems are presented.
