É nossa pretensão com o presente estudo efetuar um paralelo entre o direito do trabalho, exclusivamente, na matéria de duração do contrato de trabalho a termo, no direito Português e na possibilidade de tal contrato ser enquadrado na legislação da Ucrânia, exatamente neste momento de grandes convulsões legislativas neste País.
Aprofundámos os limites temporais do contrato a termo em Portugal, os quais seguem regras concretas e criam expetativas certas nos trabalhadores, o que, não existe na Ucrânia, onde a expetativa do trabalhador, é sempre a de um contrato precário, apenas contempla os prazos de contratação máxima, mas não proíbe a contratação sucessiva.
Se na Ucrânia se consagrasse a Lei Portuguesa relativamente aos limites de duração do contrato, seria seguramente uma mais valia para esse País.
It is our intention with this study between Portuguese and Ukraine law, exclusively in the matter of the duration of a fixed-term employment contract, and the possibility of such a contract being framed in the legislation of Ukraine, during the current transient state of Ukraine’s legislation. We consider the contract duration time limits of Portuguese law, which follow precise rules and creates certain expectations in the workers, which does not exist in Ukraine where the expectation of the workers is that of a temporary contract, which does not prohibit successive recruitment. If Ukraine were to adopt the Portuguese Law with regard to time limits for the duration of fixed term employment contracts, it would surely add value.
