Abstract(s)
Partindo da constatação empĆrica de inserção das grandes empresas como relevantes atores sociais, o presente trabalho tem como objetivo analisar os institutos da autoria e causalidade, no modo em que formulados pelo Direito Penal clĆ”ssico, tendo como paradigma uma era de direito penal individual, avaliando sua (in)suficiĆŖncia diante dos crimes da modernidade, em especial o delito ambiental empresarial, concluindo pela necessidade de um giro paradigmĆ”tico para fins de responsabilidade individual (mas nĆ£o isolada) dos membros da empresa delinquente, incluĆdos os ocupantes da alta cĆŗpula empresarial, reunidos muitas vezes em órgĆ£os colegiados, propondo a imputação de responsabilidade a tĆtulo de coautoria, com fundamento na teoria da competĆŖncia, e limitada pelas teorias causais da condição adequada, condição INUS e imputação objetiva, ademais da possibilidade de normatização, com o rigor e moderação necessĆ”rios, dos crimes de perigo abstrato em matĆ©ria penal empresarial ambiental, conduzindo a proteção penal do ambiente a um momento anterior ao resultado, atento ao princĆpio da prevenção, no denominado Direito Penal do risco.
Departing from the empirical observation of the insertion of large companies as relevant social actors, this paper aims to analyze the institutes of authorship and causality, as formulated by classic Criminal Law, having as a paradigm an era of individual criminal law, evaluating its (in)sufficiency in the face of the crimes of modernity, in particular corporate environmental crime, concluding for the need for a paradigmatic turn for the purposes of individual (but not isolated) responsibility of the members of the delinquent company, including the occupants of the top business leadership, often meeting in collegiate bodies, proposing the attribution of responsibility as co-authorship, based on the theory of competence, and limited by the causal theories of the adequate condition, INUS condition and objective imputation, in addition to the possibility of regulation, with the necessary rigor and moderation, of crimes of abstract danger in environmental corporate criminal law, leading the criminal protection of the environment to a time before the result, attentive to the principle of prevention, in the so-called Criminal Law of risk.
