A investigação que realizámos desenvolve o conceito de value based contracts a partir dos fundamentos teóricos dos conceitos de value based management e de value based health care. A partir destes conceitos – desenvolvidos, respetivamente, por teóricos ligados ao setor económico-financeiro e ao setor da saúde – explorámos um conceito que privilegia o rácio entre os resultados obtidos após a adjudicação de um contrato público (nomeadamente, durante a execução contratual) e os custos incorridos pela entidade adjudicante. A presente dissertação visa demonstrar que a contratação baseada em valor é um mecanismo que permite a integração da inovação e dos indicadores de desempenho no processo da contratação pública. A presente dissertação enquadra também o modelo de contratação pública baseado em valor no regime de contratação pública em vigor, em especial, na Diretiva 2014/24/UE e no Código dos Contratos Públicos português, e demonstra que, com base neste regime, as entidades adjudicantes podem adotar este modelo, seja por via da adoção de procedimentos para a formação dos contratos como a parceria para a inovação ou o diálogo concorrencial, seja pela definição de um critério de adjudicação que seja densificado por um conjunto de fatores (e eventuais subfatores) correspondentes a diversos aspetos da execução do contrato a celebrar, entre outros. A implementação da contratação pública baseada em valor é especialmente relevante para os setores que são pautados pela inovação contínua, onde as estratégias de contratação pública a adotar devem equilibrar a acessibilidade, o custo e a qualidade na prestação de serviços, com o melhor nível de desempenho do serviço prestado, permitindo a implementação de um modelo de contratação pública que não só tenha em consideração o interesse público da entidade adjudicante, mas que também consiga melhorar a eficiência e a responsabilização nos processos de contratação pública, criando maior valor a longo prazo.
The research we have conducted develops the concept of value based contracts based on the theoretical foundations of the concepts of value based management and value based health care. From these concepts – developed, respectively, by theorists linked to the economic-financial sector and the health care sector – we further explore a concept that prioritizes the ratio between the outcomes achieved after the awarding of a public contract (notably, during contract performance) and the costs incurred by the awarding entity. This dissertation aims to demonstrate that value based contracting is a mechanism that enables the integration of innovation and performance indicators into the public procurement process. This dissertation also frames the value based public procurement model within the public procurement regime in force, particularly in Directive 2014/24/EU and the Portuguese Public Contracts Code, and demonstrates that, under this regime, awarding entities can adopt this model, either through the adoption of contract formation procedures such as innovation partnerships or competitive dialogue or by defining an award criterion that is structured around a set of factors (and potential subfactors) corresponding to various aspects of the execution of the contract to be awarded, among others. The implementation of value based public procurement is particularly relevant for sectors characterized by continuous innovation, where the public procurement strategies adopted must balance accessibility, cost, and quality in service delivery, ensuring the highest level of service performance. This approach allows for the implementation of a public procurement model that not only considers the public interest of the awarding entity but also enhances efficiency and accountability in public procurement processes, ultimately generating greater long-term value.
