Neste artigo, é revisitado o elenco das causas de caducidade do contrato de trabalho estabelecido no Código do Trabalho português, evidenciando-se o facto de que, em várias situações, não se trata de um mecanismo automático de dissolução do vínculo entre trabalhador e empregador, e também que, por detrás dessa figura jurídica, se encontram várias justificações atípicas de despedimento individual, reconhecidas como tais pela lei. Desta constatação, resulta a provável necessidade de uma profunda revisão do conceito de "justa causa” usado, até agora, na interpretação da Constituição e consagrado no sistema de normas regulador dos despedimentos -- uma revisão assente na própria lógica do legislador e no imperativo de transparência que a inteligibilidade da lei requer.
In this article, the list of causes for the expiry of the employment contract established in the Portuguese Labor Code is revisited, highlighting the fact that, in several situations, this is not an automatic mechanism for dissolving the bond between worker and employer, and also that, behind this legal figure, there are several atypical justifications for individual dismissal, recognized as such by the law. From this observation, the probable need arises for a profound revision of the concept of "just cause" used, until now, in the interpretation of the Constitution and enshrined in the system of rules governing dismissals - a revision based on the legislator's own logic and on the imperative of transparency that the intelligibility of the law requires.
