A matéria da Propriedade Intelectual frente a especificidade do regime jurídico que a envolve pode ser entendida como um ramo do Direito que tem como objetivo tutelar as criações e invenções dos seres humanos em diversos campos e áreas tais como a das ciências exatas, humanas e biológicas. Vale destacar que sua importância está presente desde a antiguidade, e esta é entendida como um instrumento que de certa forma orienta e a defende como sendo um direito natural do homem, pois decorre do Direito da personalidade humana.
É certo que a Propriedade Intelectual dá origem a uma grande vastidão de
disputas. O Direito da Propriedade Industrial que regula as marcas, invenções, patentes, são apenas alguns exemplos dos mais variados temas que são originados por novas lides todos os dias. O intelecto humano se sobrepõe a figura do indivíduo e a imaterialidade de sua imaginação e a sua criatividade são infindáveis e intangíveis, e, portanto, não possuem limites definidos. Por isso a importância de se ter um mecanismo que esteja apto a responder de maneira eficiente e eficaz à grande ocorrência de lides no dia a dia dos seres humanos.
É nesse contexto extremamente difícil, volátil e dinâmico que o Poder
Judiciário demonstra sua fragilidade, ineficiência e ineficácia, e que, os seus limites no conhecimento de uma determinada matéria, que é extremamente técnica muitas vezes, com caráter confidencial, e valioso do ponto de vista comercial e econômico, perpassa por diversas esferas jurídicas e, sempre, carece de uma atuação e resposta ágil e rápida por parte do julgador, para que não ocorram danos as partes envolvidas. Pode-se dizer que o poder do Estado é muitas vezes inerte e incapaz de trazer soluções adequadas a determinadas matérias.
Logo, pode-se concluir que a via judiciária como única forma de resolução
dos conflitos em matéria de Direitos Intelectuais, se mostra ineficaz, insuficiente e ilógica. Por isso, a Arbitragem surge com grande força e tem ganhado cada vez mais importância nos mais variados ordenamentos jurídicos internacionais. Esses são alguns dos elementos que são típicos da Propriedade Intelectual que cada vez mais não encontram no contencioso judicial as vantagens que a Arbitragem pode oferecer para dirimir conflitos cada vez mais comuns na vida de uma sociedade global.
Diante desta enorme importância, e na maioria das vezes, com destaque para a questão econômica da matéria, o presente trabalho tem o objetivo de apresentar a sua conexão com a arbitragem em âmbito internacional, principalmente no que diz respeito ao desenvolvimento das principais problemáticas da matéria, sobretudo a questão da Arbitrabilidade dos litígios em matéria de propriedade intelectual com maior destaque e atenção aos ordenamentos Internacionais de forma comparada, com enfoque nos Direitos Português e Brasileiro.
The subject of Intellectual Property in view of the specificity of the legal regime that involves it can be understood as a branch of Law that aims to protect the creations and inventions of human beings in various fields and areas such as the exact, human and biological sciences. It is worth mentioning that its importance has been present since antiquity, and this is understood as an instrument that in a way guides and defends it as being a natural right of man, as it stems from the Law of the human personality. It is true that Intellectual Property gives rise to a wide range of disputes. The Industrial Property Law that regulates trademarks, inventions, patents, are just some examples of the most varied themes that are originated by new laws every day. The human intellect overlaps the figure of the individual and the immateriality of his imagination and creativity are endless and intangible, and therefore have no defined limits. That is why it is important to have a mechanism that is capable of responding efficiently and effectively to the great occurrence of human beings' daily lives. It is in this extremely difficult, volatile and dynamic context that the Judiciary Power demonstrates its fragility, inefficiency and ineffectiveness, and that, its limits in the knowledge of a certain subject, which is extremely technical, often confidential, and valuable from the point of view. from a commercial and economic point of view, it runs through several legal spheres and always requires an agile and quick action and response by the judge, so that the parties involved do not suffer damage. It can be said that the power of the State is often inert and unable to bring about appropriate solutions to certain matters. Therefore, it can be concluded that the judicial route as the only way to resolve conflicts in matters of Intellectual Rights, proves to be ineffective, insufficient and illogical. For this reason, Arbitration emerges with great strength and has gained increasing importance in the most varied international legal systems. These are some of the elements that are typical of Intellectual Property that increasingly do not find in the judicial litigation the advantages that Arbitration can offer to settle increasingly common conflicts in the life of a global society.In view of this enormous importance, and in most cases, with emphasis on the economic issue of the matter, the present work has the objective of presenting its connection with arbitration at an international level, mainly with regard to the development of the main issues of the matter , especially the issue of Arbitrability of intellectual property disputes with greater emphasis and attention to International regulations in a comparative way, with a focus on Portuguese and Brazilian Law.
