O presente estudo se dispõe, por meio do seu objetivo geral, em clarificar o entendimento do instituto da arbitragem, através de uma detalhada contextualização histórica, discorrendo sobre as principais inquietações da doutrina e as incongruências da legislação vigente, por meio de uma abordagem de direito comparado entre Brasil e Portugal. Tendo isso em vista, analisou-se, inicialmente, o histórico da arbitragem nos dois ordenamentos, para posteriormente elencar algumas considerações importantes para melhor entendimento do tema, como o conceito e a natureza jurídica, modalidades, fundamento legal, estruturação do procedimento e constituição dos Tribunais Arbitrais. Em um terceiro momento, discutiu-se sobre a arbitrabilidade objetiva e subjetiva, com intuito de discorrer sobre as diferenças normativas que se evidenciam na prática jurídica de cada país, principalmente quanto a questão da vinculação do instituto aos direitos patrimoniais disponíveis e a ampliação das matérias passíveis de decisões arbitrais. Debatidas as reflexões gerais sobre a arbitragem, passou-se a aludir os temas de maior alcance doutrinário e relevância normativa, tais como: procedimentalização dos centros de arbitragem em conflitos de Direito Público, a questão dos Tribunais Arbitrais Necessários, alguns fundamentos específicos dos meios de reação à decisão arbitral, a confidencialidade das decisões arbitrais administrativas e o papel do Ministério Público nos procedimentos arbitrais. Toda a matéria discutida visa abordar a arbitragem administrativa sob uma ótica de clarificar os encontros e desencontros entre a norma portuguesa e brasileiro, para que finalmente seja concluído o objetivo específico da presente dissertação, que versa sobre o futuro da arbitragem administrativa, considerando os principais anseios da doutrina quanto à necessidade específica de uma Lei de Arbitragem Administrativa e os principais desafios e obstáculos que incorram dessa possibilidade.
This study aims, through its general objective, to analyze issues of considerable doctrinal and normative repercussion on administrative arbitration, addressing the reality of comparative law between Brazil and Portugal. With that in mind, it was initially analyzed the history of arbitration in both legal systems, and then listed some important considerations for a better understanding of the subject, such as the concept and legal nature, modalities, legal basis, structure of the procedure and constitution of Arbitration Courts. In a third moment, the objective and subjective arbitrability was discussed, with the purpose of achoing the normative differences that are evidenced in the legal practice of each country, especially regarding the issue of the institute's link to available property rights and the expansion of the matters subject to arbitration decisions. Once the general reflections on arbitration have been discussed, we move on to allude to the topics of greater doctrinal scope and normative relevance, such as: proceduralization of arbitration centers in Public Law conflicts, the issue of Necessary Arbitration Courts, some specific grounds of the means of reaction to the arbitration decision, the confidentiality of administrative arbitration decisions, and the role of the Public Prosecutor's Office in arbitration proceedings. All the matter postulated aims to approach administrative arbitration from a perspective of clarifying the meetings and mismatches between the Portuguese and Brazilian norms, so that finally the specific objective of this dissertation, which is about the future of administrative arbitration, can be argued, considering the main wishes of the doctrine regarding the specific need for an Administrative Arbitration Law and the main challenges and obstacles that arise from this possibility.
