Este artigo analisa a vulnerabilidade pelo segmento social que importa maiores preocupações jurídicas: o dos pobres. São eles sujeitos de desigualdade sociais e se tornam, diante da realidade crucial experenciada, sujeitos de direitos sociais de urgência, demandando ao seu implemento uma visão universal de direitos fundamentais. Diante da crise do estado social e da proibição da proteção deficiente (Untermassverbot) tem-se, a priori, um espaço perturbador do pós-pandemia a exigir mecanismos de integração do ordenamento jurídico capazes e resilientes, aptos a conferir a esses destinatários, em situação de “vulnerabilidade vital”, o atendimento às exigências mínimas de uma nova humanização
This article analyzes the vulnerability of the social segment that needs greater legal concerns: that of the poors, victims of social inequality who, faced with the experienced reality, demand urgency, in the implementation of a universal vision of fundamental rights. Faced with the crisis of the social sate and the prohibition of deficient protection (Untermassverbot), there is a disturbing space in the post-pandemic that requires mechanisms for integrating the legal system capable of meeting the minimum requirements of a new humanization
