A presente dissertação trata da mediação e conciliação como ferramentas adequadas para o tratamento dos conflitos no Brasil e em Portugal. Ambos os institutos visam solucionar as controvérsias que inexorável e potencialmente hão de surgir entre as pessoas na sociedade.
Após uma introdução sobre a elaboração legislativa do Código de Processo Civil e da Lei de Mediação em ambos os países, serão abordados os temas de acesso à justiça para a solução de conflitos civis, definição de conciliação e mediação no Código de Processo Civil brasileiro e definição de audiência prévia no Código de Processo Civil português, bem como a interação e possíveis antinomias entre o Código de Processo Civil e a Lei de Mediação.
O tema ganha relevância no ordenamento jurídico brasileiro devido ao incentivo à mediação e conciliação no Código de Processo Civil brasileiro de 2015. O ordenamento jurídico português, por sua vez, preferiu tratar a matéria da mediação apenas em lei especial.
Além disso, a solução negocial não é apenas um meio eficaz e econômico de resolução dos conflitos: trata-se de importante instrumento de desenvolvimento da cidadania, em que os interessados passam a ser protagonistas da construção de como são reguladas as suas relações.
This dissertation deals with mediation and conciliation as adequate tools for the treatment of conflicts in Brazil and Portugal. Both institutes aim to resolve the controversies that are inexorable and potentially to arise between people in society. After an introduction on the legislative drafting of the Civil Procedure Code and the Mediation Law in both countries, the issues of access to justice for the resolution of civil conflicts, definition of conciliation and mediation in the Brazilian Civil Procedure Code and definition prior hearing in the Portuguese Civil Procedure Code, as well as the interaction and possible antinomies between the Civil Procedure Code and the Mediation Law. The subject gains relevance in the Brazilian legal system due to the incentive to mediation and conciliation in the Brazilian Code of Civil Procedure of 2015. The Portuguese legal system, in turn, preferred to deal with mediation matters only in special law. In addition, the negotiation solution is not only an effective and economical means of conflict resolution: it is an important instrument for the development of citizenship, in which stakeholders become protagonists in the construction of how their relations are regulated.
