O objetivo do trabalho é verificar se as leis que estão em andamento ou já em vigor conseguem arrefecer o fenômeno das notícias falsas compartilhadas nas redes sociais em período de campanha eleitoral e assim evitar que isso possa influenciar no voto do eleitor. Para isso, utliza-se da técnica da ponderação e observa-se se a liberdade de expressão não é restringida de maneira indevida face à preponderância do princípio democrático. O trabalho mostra-se relevante, pois é um tema muito recente e que vem preocupando os Estados Democráticos, uma vez que é capaz de influenciar o instrumento de participação dos cidadãos. Além disso, sendo observado no contexto do Brasil, país que vem dedicando bastante atenção ao tema, ainda não há um consenso sobre como deve ser solucionada a questão, embora existam iniciativas que visam tal finalidade. Dentro das possibilidades existem dois caminhos: o da punição e proibição do compartilhamento e publicação pelos usuários das redes, e o outro que visa a responsabilização das redes, como um sistema de compliance. Desta maneira, é utilizado o método hipotético-dedutivo e uma análise bibliográfica e documental, que podem levar a conclusão de que a liberdade de expressão, quando na hipótese de leis punitivas e restritivas de liberdade aos usuários das redes sociais, mostra-se excessiva, uma vez que existem medidas menos onerosas à tal principio, uma delas é dar maior responsabilidade aos provedores de aplicações de internet.
The objective of the work is to verify if the laws that are in progress or already in force are able to cool the phenomenon of fake news shared on social networks during the electoral campaign period and thus avoid that this may influence the voter's vote. For this, we use the balancing of rights technique and observe if freedom of expression is not unduly restricted in view of the preponderance of the democratic principle. The work proves to be relevant, as it is a very recent topic that has been worrying the Democratic States, since it is capable of influencing the instrument of citizen participation. Furthermore, being observed in the context of Brazil, a country that has been devoting a lot of attention to the topic, there is still no consensus on how the issue should be resolved, although there are initiatives that aim to this end. Within the possibilities there are two paths: the punishment and prohibition of sharing and publication by the users of the networks, and the other that aims at the accountability of the social networks, as a compliance system. In this way, the hypothetical-deductive method and a bibliographic and documentary analysis are used, which can lead to the conclusion that freedom of speech, when in the hypothesis of punitive and restrictive laws of freedom to users of social networks, is excessive, since there are less costly measures to this principle, one of them is to give greater responsibility to the providers of internet applications.
