A atuação do agente infiltrado em organizações criminosas pode ser considerada indispensável para a investigação criminal. Caso o agente recolha a prova agindo como autor de crimes, quais as soluções que o ordenamento jurídico português e brasileiro prevê? Quais as condutas permitidas e proibidas ao agente para que haja ou não punibilidade penal? Haverá punição ao agente que provocar o investigado a praticar crimes? O regime jurídico das ações encobertas será aplicado de forma independente, subsidiária ou cumulativa ao Código Penal? Se os atos do agente infiltrado forem ilícitos, a prova por ele produzida/colhida poderá ser considerada válida no Processo Penal? O que a teoria do duplo efeito tem haver com esse problema? A elevada complexidade jurídica do tema em discussão dificulta a construção de cada resposta. Contudo, buscaremos encontra las junto à legislação, doutrina e jurisprudência, tendo por base o conceito analítico de crime, a lei portuguesa n.º 101 de 2001 e a lei brasileira n.º 12.850 de 2013.
The action of the infiltrated agent in criminal organizations may be considered essential for the criminal investigations. In case the agent collects the evidence acting as the author of the crime, what are the solutions the portuguese and brazilian legal order predict? What are the allowed and prohibited conducts to the agent for the existence or not of a penal punishment? Will be there punishment to the agent who provokes who is being investigated to commit crimes? The legal regime of covered actions will be implement in an independent, subsidiary or cumulative way to Penal Code? If the acts of the infiltrated agent are illicit, the evidence produced/collected by him can be considered valid in Penal Process? How is the double effect theory related to that problem? The elevated judicial complexity of the topic in debate makes difficult the construction of each answer. However, we will seek to find them closely with the law, doctrine and jurisprudence, based on analytical concept of crime, the portuguese law number 101 from 2001 and the brazilian law number 12.850 from 2013.
