Despertado o interesse sobre a matéria de recursos para o Supremo Tribunal de Justiça, nomeadamente no que toca à limitação do seu acesso através da regra de dupla conformidade e inerente exceção implementada pela hipótese da interposição de recurso de revista a título excecional, cujo regime jurídico se encontra consagrado no artigo 672.º do atual Código de Processo Civil, tão recente no nosso processo civil, mais exatamente, desde 2007, através do Decreto-Lei n.º 303/2007, de 24 de Agosto, que alterou o ainda em vigor, nessa data, Código de Processo Civil de 1961, aguçou-se a curiosidade em consultar jurisprudência relativa ao assunto, de modo a obter mais conhecimento sobre o regime legal referente a este recuso.
Através de uma rápida leitura de um número considerável de acórdãos do Supremo Tribunal de Justiça, foi possível verificar que existe uma alta taxa de não admissão do recurso de revista excecional, aproximadamente, apenas quarenta porcento dos requerimentos de interposição deste recurso são admitidos.
Por esse motivo, assumiu-se o compromisso de estudar e, principalmente, repensar, detalhadamente, o regime, trâmites e pressupostos gerais e específicos deste tipo de recurso, recorrendo, maioritariamente, à análise de jurisprudência do Supremo Tribunal de Justiça com relevo para o assunto, mas não só. Tal estudo baseou-se também na consulta de doutrina de referência na área do processo e dos recursos em processo civil.
A partir daí, foi possível efetuar uma análise crítica e pragmática de como as regras relativas a este tipo de recurso têm sido aplicadas nos nossos tribunais. Concluiu-se, não só pelo facto de o regime previsto no artigo 672.º do CPC estar bastante incompleto, e contraditório entre si, no que toca à sua interpretação, bem como pelo facto de ser inconciliável a utilização de conceitos indeterminados, nos pressupostos específicos de admissibilidade do recurso de revista excecional, com o caráter definitivo da decisão de admissão ou não admissão proferido pela formação ad hoc, nos termos do n.º 4 do artigo 672.º do Código de Processo Civil.
Aroused that was the interest about the matters of appeals to the Supreme Court of Justice, in particular as regards the limitation of its access through the rule of double conformity and inherent exception implemented by the hypothesis of the filling of an appeal for review on an exceptional basis, whose legal regime it’s enshrined in article 672 of the current Code of Civil Procedure, so recent in our civil process regime, more precisely, since 2007, through Decree-Law no. 303/2007, of August 24, which amended the still in force, on that date, Code of Civil Procedure of 1961, it was sharpened the curiosity to consult jurisprudence on the subject, in order to obtain more knowledge about the legal regime regarding this kind of appeal. Through a quick reading of a considerable number of decisions of the Supreme Court of Justice, it was possible to verify that there is a high rate of non-admission of the exceptional revised appeal, approximately, only forty percent of the applications for this kind of appeal are admitted. For this reason, a commitment was made to study and, mainly, to rethink, in detail, the regime, procedures and general and specific requirements of this type of appeal, call upon mainly to the analysis of jurisprudence of the Supreme Court of Justice with emphasis to the subject, but not only. This study was also based on consultation of reference doctrine in the area of the civil process and civil appeals. From then on, it was possible to carry out a critical and pragmatic analysis of how the rules regarding this type of appeal have been applied in our courts. It was concluded not only that the system provided for the Article 672 of the CPC was quite incomplete and contradictory in relation to its interpretation, but also that the use of indeterminate concepts in the specific requirements was irreconcilable with the definitive nature of the admission or non-admission decision issued, in accordance with paragraph 4 of article 672 of the Code of Civil Procedure.
