A dupla conforme em recurso cível : a conformidade decisória em especial

A dupla conforme consiste num pressuposto negativo de admissibilidade do recurso de revista para o Supremo Tribunal de Justiça, pelo que foi precisamente introduzida, com o propósito de filtrar o acesso a esta instância máxima.
Este pressuposto, que se encontra presente no n.º3 do art.º 671 do Código de Processo Civil, verifica-se sempre que acórdão da Relação confirme, sem voto de vencido e sem fundamentação essencialmente diferente, a decisão proferida pela 1.ª instância.
Assim, podemos afirmar que a dupla conforme apresenta três requisitos de aplicação: a ausência de voto de vencido, a fundamentação essencialmente idêntica, e a conformidade decisória.
O requisito da conformidade decisória, o mais importante e objeto da presente dissertação, é o que mais tem levantado problemas, no sentido em que tanto na doutrina como na jurisprudência, o caminho tem-se dividido, dando origem a duas posições distintas: a tese da dupla conforme plena e a tese da dupla conforme mitigada. A primeira defende que para estarmos perante uma dupla conforme, o acórdão da Relação deverá ter confirmado exata e irrestritamente, o proferido na decisão da 1.ª instância. Por sua vez, a segunda teoria, mais recente, veio defender que, perante uma desconformidade quantitativa entre as instâncias, ainda assim se deve considerar por verificada uma dupla conforme.
Ora, esta dualidade de entendimentos têm dado origem a decisões diferentes no âmbito de admissibilidade dos recursos para o Supremo, sendo que, pretendemos com a presente dissertação, aprofundar a problemática existente em torno da dupla conforme na sua vertente da conformidade decisória, fazendo uma abordagem aprofundada das teorias existentes e fazendo sempre referência à controvérsia no âmbito da
jurisprudência, procurando por fim, tomar uma posição e chegar a uma solução adequada de aplicação da regra da dupla conforme.
The double conformity consists of a negative assumption of the admissibility of the review appeal to the Supreme Court of Justice, as it was precisely introduced, with the purpose of filtering access to this maximum instance. This assumption, which is present in no. 3 of article 671 of the Code of Civil Procedure, it is always verified when the judgment of the Relation confirms, without a vote of defeat and without essentially different reasoning, the decision pronounced by the 1st instance. Thus, we can affirm that the double conformity complies with three requirements of application: the absence of a vote of defeat, the essentially identical reasoning, and the conformity of decision. This last one, which is the most important requirement and the object of this dissertation, is the one that has raised the most problems in the sense that in both doctrine and jurisprudence the path has been divided into two distinct positions: the thesis of the pair in full and the thesis of the pair as mitigated. The first argues that in order to be before a compliant couple, the Relation judgment must have confirmed exactly and unrestrictedly, the one pronounced by the decision of the first instance. On the other hand, the second theory, more recent, came to argue that, faced with a quantitative disagreement between the instances, it should nevertheless be considered as a double conformity. However, this duality of understandings has given rise to different decisions regarding the admissibility of appeals to the Supreme Court, and we intend, with this dissertation, to deepen the existing problematic of the double according to its aspect of decision compliance, taking an approach of the existing theories and always making reference to the controversy within the jurisprudence, seeking, finally, to take a position and to arrive at an appropriate solution of application of the rule of double conformity.
