Abstract(s)
Embora consista em um conteĆŗdo relativamente novo no universo jurĆdico, a boa administração vem gradativamente conquistando seu espaƧo e adquirindo destaque, especialmente em termos de discussƵes doutrinĆ”rias, de forma a refletir uma temĆ”tica de extrema relevĆ¢ncia para o atual contexto jurĆdico, polĆtico e social. O nĆŗcleo inerente a boa administração, assim, firma seus alicerces nĆ£o somente no entendimento doutrinĆ”rio, mas tambĆ©m em recentes e diversos textos legais, tanto em sede europeia, como no Ć¢mbito dos ordenamentos nacionais. Seu teor, ademais, reflete duas perspectivas, sendo que uma das facetas corresponde a um princĆpio que orienta toda a atuação empenhada pela Administração PĆŗblica, enquanto a outra vertente constitui um direito fundamental que cuja substĆ¢ncia passa justamente pela fixação de condutas e prĆ”ticas administrativas correta e adequadamente desempenhadas. Ambas as perspectivas associadas ao tema da boa administração serĆ£o melhor apresentadas e abordadas nas suas caracterĆsticas e especificidades ao longo deste trabalho. A boa administração, desse modo, visa assegurar que todo o conjunto de atividades desenvolvidas no domĆnio da Administração PĆŗblica serĆ” bem realizado nas suas mais variadas etapas, de tal maneira que, de fato, revelem-se capazes de atender efetivamente os interesses da coletividade. Apresenta-se, assim, como uma relevante ferramenta para a garantia de uma concreta tutela dos direitos dos indivĆduos, tanto no respeito pelos direitos subjetivos de ordem administrativa, como na efetivação do conjunto de direitos fundamentais. O potencial de influĆŖncia da boa administração, nessa esteira, pode atingir ampla e profundamente a mentalidade administrativa, de modo a estimular os agentes e os órgĆ£os administrativos no exercĆcio consciente, responsĆ”vel e atento de suas funƧƵes, tambĆ©m em observĆ¢ncia a um grupo de parĆ¢metros, de modo a ter como foco o apropriado alcance de determinados objetivos. A extensĆ£o do seu conteĆŗdo, bem como as particularidades e eventuais questƵes extraĆdas do seu nĆŗcleo serĆ£o tratadas no presente trabalho.
Although it is a relatively new content in the legal universe, good administration is gradually gaining ground and earning prominence, especially in terms of doctrinal discussions, in order to reflect a topic of extreme relevance to the current legal, political and social context. The nucleus inherent in good administration thus establishes its foundations not only in the doctrinal understanding but also in recent and diverse legal texts, both in Europe and in the framework of national laws. Its content, moreover, reflects two perspectives, one facet being a principle that guides all the work undertaken by the Public Administration, while the other is a fundamental right whose substance runs through the establishment of properly performed administrative conducts and practices. Both perspectives associated to the theme of good administration will be better presented and addressed in its characteristics and specificities throughout this work. Good administration thus aims to ensure that the whole set of activities developed in the field of Public Administration will be well performed in its most varied stages, in such a way that, in fact, they are able to effectively meet the interests of the collectivity. It is thus presented as a relevant tool for guaranteeing a concrete protection of the individuals rights, both in respect of subjective rights of administrative order and in the implementation of the set of fundamental rights. The potential influence of good administration therefore can reach broadly and deeply the administrative mentality, in order to stimulate the agents and the administrative organs in a conscious, responsible and attentive exercise of their functions, also in compliance with a group of parameters, in order to achieve certain objectives. The extension of its content, as well as the particularities and possible questions extracted from its nucleus will be treated in the present work.
