O presente trabalho tem como escopo o estudo da responsabilidade civil pela perda de uma chance, sobretudo diante da evolução do instituto na sociedade pós-moderna, onde a vítima passa a ter papel de destaque.
Nossas pesquisas iniciam com o desenvolvimento da responsabilidade civil ao longo do tempo, passando principalmente pelas divergências relativas às teorias que abarcam o nexo de causalidade, relacionando, ainda, seus pontos de contato e de conflito com a perda de chance.
Após referida contextualização, tracejamos algumas linhas acerca da evolução histórica da perda de uma chance propriamente dita, com enfoque nos Direitos Francês e Italiano, berços da teoria.
Em seguida, nos debruçamos sobre os elementos que compõem a perda de uma chance, ressaltando as divergências estabelecidas, tanto doutrinária como jurisprudencialmente, acerca de eventual relativização dos conceitos ortodoxos sobre o nexo de causalidade ou decorrentes de alargamento do conceito de dano.
Chamamos a atenção para a diferença estabelecida entre a perda de uma chance dita clássica e a perda de uma chance na seara médica (perda da chance de cura e/ou de sobrevivência), não descurando dos demais campos de aplicação da teoria que reputamos importante mencionar (perda de chance nas relações familiares e trabalhistas).
Destacamos a dificuldade no tocante aos critérios utilizados para a fixação da indenização decorrente do dano de perda de chance e a celeuma existente no tocante à sua natureza jurídica.
O estudo aborda primordialmente a análise dos pensamentos dos julgadores brasileiros e portugueses, na medida em que sabemos que a vida conforma o Direito.
Por fim, apresentamos nosso contributo à teoria, com a finalidade de, aliados àqueles que entendem necessário o instituto, buscarmos, sempre, o mínimo de eficiência reparatória às vítimas de danos que, em outros momentosda história, não eram sequer, lembradas.
This work aims at studying the civil liability for loss of a chance, especially on the development of the institute in postmodern society, where the victim has acquired a prominent role. The first part of this research will discuss the development of the civil liability over time, emphasizing, mainly, the deviation on theory that includes the causation, as well as your points of contact and conflict with the loss of chance. In addition, it will expound a few lines about the historical evolution of the loss of a chance itself, based on French and Italian Rights, considered the cradle of the theory. Furthermore, it will show the elements that compound the loss of a chance, highlighting the differences established, both doctrinal and jurisdictional, about possible relativization of the orthodox concepts of causation or resulting from extending the concept of damage. Moreover, it would draw the attention the difference stablished between the loss of a chance known as classical and the loss of a chance in the medical aspect (loss of chance of cure and / or survival), not forgetting the other fields of application of the theory that it is important to mention (loss of chance in family and labor relations). This work also highlights the difficulties regarding to the criteria used for compensation resulting from the loss of chance of damage and the conflict regarded to its legal nature. This study primarily deals with the analysis of the thoughts of Brazilian and Portuguese judges, to the extend that life shapes the law. Finally, it will present the contribution to the theory, with those who understand the need of the institute, in order to seek, always, the minimum efficiency reparation for victims of damage, who at other times in history, were not even remembered.
