A Carta dos Direitos Fundamentais da União Europeia e o nível mais elevado de proteção

Abstract

A contínua integração internacional entre os Estados comunitários levou à criação daquilo que se denominou de garantia multinível dos direitos fundamentais. Na Europa, tal tutela ocorre por meio da proteção dos direitos fundamentais não apenas pelas Constituições dos Estados-membros, mas também pela Carta dos Direitos Fundamentais da União Europeia e pela Convenção Europeia dos Direitos do Homem. Entretanto, a existência de várias instâncias protetivas não leva automaticamente à maior proteção dos direitos fundamentais dos cidadãos. Analisa-se neste sentido o caso Melloni e posteriores julgados, em que o Tribunal de Justiça da União Europeia acabou por dar interpretação discutível ao nível mais elevado de proteção dos direitos fundamentais de um determinado cidadão. Para atingir tal objetivo, esta dissertação apresenta inicialmente determinados conceitos doutrinários referentes à tutela dos direitos fundamentais, Carta dos Direitos Fundamentais da União Europeia e o princípio do nível mais elevado de proteção; para, então, analisar alguns dos riscos envolvidos em tal tutela; e, por fim, faz-se uma análise do caso Melloni, mostrando como ocorreu tal interpretação relativa ao nível de proteção. A finalidade da presente dissertação é, portanto, buscar uma abordagem sistemática sobre a Carta dos Direitos Fundamentais da União Europeia e ao Princípio do nível mais elevado de proteção, com o fito de tornar mais nítidas as bases de sua fundamentação constitucional, tendo em vista as questões trazidas ao arcabouço jurídico internacional com a publicação do Acórdão C-399/11 – caso Melloni, proferido pelo Tribunal de Justiça da União Europeia.

The continued international integration among the EU states led to the creation of what was termed the multi-level guarantee of fundamental rights. In Europe such protection takes place through the protection of fundamental rights not only by the constitutions of the Member States but also by the Charter of Fundamental Rights of the European Union and the European Convention on Human Rights. However, the existence of several protective instances does not automatically lead to greater protection of citizens' fundamental rights. In this regard, the Melloni case and subsequent judgments are analyzed in which the Court of Justice of the European Union gave a debatable interpretation to the highest level of protection of the fundamental rights of a particular citizen. In order to achieve this objective, this dissertation initially presents certain doctrinal concepts regarding the protection of fundamental rights, the Charter of Fundamental Rights of the European Union and the principle of the highest level of price; to analyze some of the risks involved in such protection; and finally, an analysis of the Melloni case is made, showing how such an interpretation occurred regarding the level of protection. The purpose of this dissertation is to seek a systematic approach to the Charter of Fundamental Rights of the European Union and to the principle of the highest level of protection, with a view to clarifying the basis of its constitutional issues brought to the international legal framework with the publication of Judgment C-399/11 - Melloni case, delivered by the Court of Justice of the European Union.
